Job Duties Nursery Worker:
The below duties are all performed at nursery and Moon Valley farm property locations in the Los Angeles-Long Beach-Anaheim, CA Metropolitan Statistical Area. Plant, grow, sell and install shade, ornamental and evergreen trees and other landscape plant material such as shrubs, annual and perennial plants, grasses, ground-covers and bulbs on farm/nursery properties. Installing drip irrigation for plant stock on farm properties. Building tree boxes and light vehicle maintenance. Digging holes with a shovel or trowel and installing plant material such as trees, shrubs, annual and perennial plants, ground-covers and bulbs on farm; hauling and spreading top soil and/or mulch, lifting, carrying and spreading 50 lb. bags of mulch; installing posts and attaching ties from planted trees to support stakes on farm properties; pruning and trimming trees, shrubs and hedges; wrapping trees, watering plant material using hoses or buckets; hand pulling weeds, spreading fertilizer, pesticides, chipping, raking, edging mowing, green waste removal and trimming fields and lawns. Workers will operate a forklift to load pallets of packed product grown on farm into refrigerated trucks as directed and trained by Supervisory Personnel. Operate Kubota to be able transport products around the nursery. Driving golf carts around the nursery yard to pick up products get from around the yard. Must be able to lift 50 lbs. consistently on a daily basis. Overtime may be offered. Hours may vary based on weather. In addition to the above duties that are performed on the farm/nursery properties, the workers may travel on occasion to customer locations for the sole purpose of installing trees and shrubs that are grown on the farm/nursery by Moon Valley. No other work will be performed at off-site locations. Under the FLSA, the planting of trees and bushes is within the scope of agriculture where it constitutes a step in the production, cultivation, growing, and harvesting of agricultural or horticultural commodities, or where it constitutes a practice performed by a farmer or on a farm as an incident to or in conjunction with farming operations. Thus, employees of the nurseryman who raised such nursery stock are doing agricultural work where they plant the stock on private or public property, trim, spray, brace, and treat the planted stock, or perform other duties incidental to its care and preservation. All trees and shrubs being installed off of farm property have been grown, cultivated and harvested on Moon Valley farm/nursery properties, which is their primary business. The workers will not perform landscaping duties. 8 Cal. Code Regulations Section 3437, 3456 (b-c).The hand weeding task is performed without bending, stooping, squatting, or kneeling. This task shall be performed in an upward position done while walking throughout the nursery. Weeds will be pulled from box containers that are normally waist high. PPE worn will be steel toe & waterproof boots, gloves, and eye protection. The employer will abide by 8 Cal. Code Regulations Section 3437, 3456(b-c) H-2A General Assurances (guarantees to workers) Housing The employer must provide free housing to all workers who are not reasonably able to return to their residences on the same day. Meals The employer must provide either three meals a day to each worker or furnish free and convenient cooking and kitchen facilities. If meals are provided, the employer may charge each worker a certain amount per day for the three meals. Transportation After a worker has completed 50 percent of the work contract period, the employer must reimburse the worker for the cost of transportation and subsistence from the place of recruitment to the place or work, if such costs were borne by the worker. The employer must provide free transportation between the employer's housing and the work site for any worker who is provided housing. Upon completion of the work contract, the employer must pay the worker's subsistence and return transportation to the place of recruitment. Special conditions apply when the worker will not be returning to the place of recruitment because of another job. Workers Compensation Insurance The employer must provide workers' compensation insurance where it is required by law. Tools and Supplies The employer must furnish at no cost to the worker all tools and supplies necessary to carry out the work unless it is common practice in the area and occupation for the worker to provide certain items. Three-fourth Guarantee The employer must guarantee to offer each worker employment for at least three-fourths of the workdays in the work contract period and any extensions. If the employer affords less employment, then the employer must pay the amount which the worker would have earned had the worker been employed the guaranteed number of days. Other Conditions The employer must provide the worker with a complete statement of hours worked and related earnings on each payday. The employer must pay the worker at least twice monthly or more frequently if it is in the prevailing practice to do so. The employer must provide a copy of a work contract or the job order to each worker. The employer shall comply with applicable federal, state, and local employment-related laws and regulations, including employment-related health and safety laws. No U.S. worker will be rejected for or terminated from employment for other than a lawful-job-related reason and notification of all rejections or terminations shall be made to EDD. Deberes de Trabajo Trabajador de vivero: Las siguientes tareas se realizan en el vivero y en las propiedades agrícolas de Moon Valley, ubicadas en el área metropolitana de Los Ángeles-Long Beach-Anaheim, California. Se requiere plantar, cultivar, vender e instalar árboles de sombra, ornamentales y de hoja perenne, así como otras plantas ornamentales como arbustos, plantas anuales y perennes, césped, cubresuelos y bulbos en las propiedades agrícolas/de vivero. También se requiere instalar sistemas de riego por goteo para las plantas en las propiedades agrícolas, construir alcorques y realizar mantenimiento ligero de vehículos. Además, se requiere cavar hoyos con pala o paleta e instalar plantas como árboles, arbustos, plantas anuales y perennes, cubresuelos y bulbos en la finca; transportar y esparcir tierra vegetal y/o mantillo, levantar, cargar y esparcir sacos de mantillo de 22.7 kg (50 lb); instalar postes y sujetar ataduras de los árboles plantados a las estacas de soporte en las propiedades agrícolas; podar y recortar árboles, arbustos y setos; envolver árboles y regar las plantas con mangueras o cubos. Las tareas incluyen deshierbar manualmente, esparcir fertilizantes y pesticidas, triturar ramas, rastrillar, perfilar bordes, cortar residuos vegetales y recortar campos y césped.
