  • Job Description:
  • Handles subpoenas and garnishment issues.
Advises on legal aspects of patient care, including informed consent, medical records, privacy issues, and patients' rights issues. Provides guidance on revenue cycle matters and other healthcare provider requirements. Advises chief executive officers, executive management, compliance department, and medical staff leadership on healthcare and legal issues. Facilitates peer review processes and addresses medical staff issues. Manages licensing requirements and informed consent procedures. Oversees various types of leases, including space and equipment leases. Provides guidance on local, state, and federal statutes, including Stark Law and Anti-kickback statute and implementing regulations. Manages compliance with other applicable regulations. Addresses provider employment issues and physician practice issues. Drafts and negotiates professional service agreements and affiliation agreements. Conducts due diligence and ensures HIPAA compliance.
  • Knowledge, Skills, and Abilities:
  • Ability to deliver a response to stakeholders succinctly
  • Excellent writing, communication, and organizational skills
  • Excellent problem-solving skills
  • Proficiency in legal research, including Lexis and other research tools
  • Knowledge of health care law, including principles of Medicare reimbursement programs, anti-fraud statutes and programs including the Medicare Fraud and Abuse (Anti-Kickback) Statute, Stark Law, False Claims Act, and Civil Monetary Penalty Act, HIPAA and their implementing regulations
  • Knowledge of federal and state tax law, real estate law, tort law, and contract law as those areas relate to health care law
  • Ability to work effectively with others as well as work independently, without close supervision
  • Familiarity with Microsoft's office suite and other software applications
  • Strong analytical abilities and ability to work effectively under strict time constraints
  • Ability to think logically and possess a strong affinity for healthcare operations
  • Keen analytical skills; ability to exercise sound judgment in triaging competing priorities
  • Experience negotiating with opposing counsel and driving practical solutions
  • Comprehensive knowledge of legal publications and the ability to use them efficiently including computer-assisted research
  • Specific experience in hospital regulatory compliance, acquisition transactions, and understanding of financial statements and concepts [Preferred]
  • Knowledge of legal principles and labor and employment law, commercial law, contracting, and health information technology legal background including HIPAA, GDPR, Cures Act
  • Ability to perform at a high level in a fast-paced environment and work progressively with many individuals on projects as a team player
