Columbus

GA 31904.

Whereas the community desires to engage services of __________________________________, an independent contractor, to provide professional hair care services to residents of the above stated community. Now, therefore on _____________________, in consideration of the mutual agreements and promises hereinafter to set forth, the parties here to agree: 1.

Functions and responsibilities of contractor:

a. Provide community with a copy of present year's license to practice profession. Contractor will also keep a copy posted in salon. b. Contractor will provide to community sufficient proof of insurance, with a minimum of $1 million Liability coverage naming community as additional insured. c. Contractor shall provide to community an itemized bill detailing services to each resident on the form supplied by the community. d. Contractor will provide all necessary supplies needed to perform services for residents. e. Contractor hereby agrees to perform all tasks necessary to ensure compliance with all appropriate state regulations. f. Contractor is an independent contractor and as such agrees to perform their service in a professional manner in accordance with applicable standards recognized by the cosmetology profession. g. Contractor agrees to maintain the salon per Thrive's housekeeping standards. h. Contractor agrees to indemnify and hold harmless the community from all acts of omissions of contractor. i. Contractor agrees to a 85% 15% split of all monies billed to resident, (85% to contractor, 15% to community) payable to contractor. Contractor is responsible for submitting a list of all services rendered and charge per service per resident at the end of each day salon services are provided. j. Contractor agrees to submit to a state and FBI fingerprint check and tuberculosis screening at community's cost. 2.

Functions and responsibilities of community:

a. Community will make available to contractor a work area appropriate as a salon, as well as maintain equipment in good working order. b. Community shall make available to contractor any of its records necessary for the contractor to carry out their responsibilities under the terms of this agreement. c. During the term of this agreement, community retains all rights to the salon as prescribed by state and federal law, which prohibits discrimination based upon race, creed, age, color, national origin, sex, disability, sexual preference, marital status or sponsorship, the services described above will be furnished on a non-discriminatory basis. Wherefore, the undersigned affix their signature in agreement with the terms and conditions set forth hereinabove, this agreement to commence on the date first written above and will continue for a twelve (12) month period with annual renewal provisions. Either party upon giving a thirty (30) day written notice may terminate this agreement.
