Agency Dept of Justice Division DOJ Legal Services Job Classification Title Attorney III (NS) Position Number 60010547 Grade LG08 About Us The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs' and Criminal Justice Education and Training Standards Divisions.

IMPORTANT NOTE:

Some key duties of this role are: - Represent the NC Department of Labor in complex litigation including civil and administrative cases involving various regulatory programs that may involve constitutional issues, public policy concerns or issues that may impact economic conditions, human resources, or a wide segment of the general public. Occupational Safety and Health Act (OSHA) litigation often involves negotiating and drafting novel or complex settlement stipulations in order to address the often delicate and peculiar hazards existing on employers' worksites. - Advise the DOL on REDA, Civil Rights Actions and other Legal Matters. This position is responsible for providing legal advice in the areas of labor and employment law, constitutional law, public records laws, bankruptcy, administrative procedures, and other topics to DOL. This position responds to inquiries from DOL concerning such diverse matters as the interpretation and/or applicability of the various statutory provisions; essential elements needed to prove particular claims; evidence needed to rebut an employer's stated defense; the adoption of rules relating to DOL's various enforcement activities; the conducting of conciliation or other forms of informal dispute resolution processes; the issuance of right-to-sue letters; possible federal preemption issues; obtaining injunctive relief; and, penalties or damages which may be allowed pursuant to the various statutory claims. The position oversees the preparation of warrants and affidavits for use in DOL enforcement investigations to present to the Superior court in order to gain entry to conduct inspections in the workplace; advises DOL employees on all matters regarding entry onto employer premises by court order pursuant to a warrant; and initiates court proceedings as appropriate, including the bringing of contempt actions against employers who refuse to allow inspections. - Prepare administrative warrants and subpoenas. - Draft and argue appellate criminal matters.
Knowledge Skills and Abilities/Management Preferences Management Preferences:
Experience litigating cases in a variety of forums, including administrative tribunals and State and Federal courts. Ability to multi-task and prioritize case deadlines successfully Ability to work independently Strong legal writing skills.
