As General Counsel, is responsible for the following functions: Furnishes legal advice and services on all mters arising from, or pertaining to, activities of the ste Nional Guard and ste militia. Exercises oversight over the day-to-day legal operions within the ste Nional Guard and ste militia. Serves as the ste Nional Guard claims officer. Provides staff oversight and legal advice on all non-contractual claims arising from operions of the ste Nional Guard. Furnishes legal advice regarding the applicion of restrictions and limitions contained in authorizion and appropriion acts, and reled legislion as they affect the ste NG. Furnishes legal advice and assistance on all legal mters involving the acquisition, management, or disposal of real este interests within the ste NG. Provides staff oversight and legal advice on all litigion mters affecting the ste Nional Guard, and provides liaison with DoD, services, and NGB. Oversees and administers the ste NG military justice program. 2. LABOR AND EMPLOYMENT COUNSEL DUTIES
Provides legal advice and assistance to ste NG on the full spectrum of civilian personnel management and administrion including difficult issues involving staffing, recruitment, assignment, performance management, pay and allowances, training, promotion, discipline, appeals and dispute resolution. 3. TRIAL ATTORNEY DUTIES
Acts as trial torney for employment reled administrive hearings, investigions, and litigion for ste NG. Appears before investigors, examiners, and Administrive law judges, representing ste NG the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity commission (EEOC), Federal Labor Relions Authority (FLRA). 4. COUNSEL FOR CONTRACT AND FISCAL LAW DUTIES
Incumbent serves as ste NG contract and fiscal law counsel. In this role the incumbent provides expert, authoritive legal advice to the ste NG on all aspects of contract and fiscal law. 5. OTHER LEGAL DUTIES
Provides oversight of a broad scope of responsibilities in the areas of general law. Incumbent renders professional advice and legal opinions on (1) security, intelligence, proper use memorandum, CYBER; (2) guidance for ste NG participion in community and Nional Security Significant Events (NSSE) and the activities of prive associions; (3) inter-service support agreements; (4) official Investigions by Federal agencies; and, (5) domestic operions law counsel including defense support of civil authorities. 6. Must obtain and maintain a Secret clearance. Incumbent must be an active member of the bar in good standing in Colorado. Must possess a valid ste driver's license to opere government motor vehicles, for the ste in which they live or are principally employed, in accordance with Army and Air Force Vehicle Operions Directives. As an Officer in the Army Nional Guard JAG Corps, must have completed the 14-week Judge Advoce General Basic Course. No record of conviction by civilian courts of offenses listed in the applicable Service Military Justice regulions. Must not have any military disciplinary action on military records for engaging in an unprofessional or inapproprie relionship as defined in applicable DoD Instructions concerning Army and Air Force Professional and Unprofessional Relionships. Able to recognize and identify complex constitutional, ste-federal, and military-civilian jurisdictional issues frequently associed with the organizion and administrion of the Title 32 Nional Guard, and articule them in the approprie forum or context. 11. Competent in providing legal interpretion and guidance to managers and senior leaders on 10 United Stes Code, and the ste equivalent to the federal Uniform Code of Military Justice. 12. Experienced in researching and providing legal advice in all functional areas of Administrive, Labor, Medical and Physical Disability, and Ethics Law. 13. Experienced in developing and providing solutions to conflicting or contradictory DoD regulions, directives, and policies, and other NGB or ste legal guidance. 14. Experienced in preparing memoranda of reports th outlined and analyzed the factual and legal issues and have experiences involved preparing legal documents or advisory opinions, participed in contract negions, and examined documents for legal sufficiency.
