This is a highly responsible position that serves as Deputy Chief Attorney and performs administrative prosecution of violations for assigned professions under the jurisdiction of the department, including Chapter 455, Florida Statutes, and all applicable practice acts.Your Specific Responsibilities:
Duties include, but may not be limited to: Provides leadership and guidance to assigned law clerks and other division employees; Evaluates investigative reports and evidence; Analyzes violations of statutes or administrative rules for regulated professions and recommends appropriate action; Researches/drafts/reviews/amends pleadings, complaints, motions, dismissal orders, consent orders, settlement agreements and memoranda of law; Negotiates settlements; Reviews, edits, and evaluates proposed rule packages; Responds to consumer and industry inquiries; Analyzes bills; Compiles exhibits; Prepares witnesses to testify; Takes and defends depositions; Initiates and responds to discovery; Prosecutes and defends enforcement actions before the Division of Administrative Hearings and the agency's informal hearing officer; Prosecutes and defends final orders, emergency suspension orders, declaratory judgments, and rule waiver and variance decisions; Provides legal advice to division staff and other agency employees.Knowledge, Skills, and Abilities:
Ability to supervise; Ability to understand and apply applicable rules, regulations, and policies; Skill in drafting legal documents; Skill in managing multiple complex cases; Ability to prioritize work; Ability to work independently and in a team environment; Ability to communicate effectively; Ability to conduct legal research; Ability to make oral presentations in court and in large groups; Ability to recognize and act on emerging issues and shifting priorities; Ability to travel.Minimum Qualifications:
Must have a valid driver's license; and Must be a member of The Florida Bar in good standing; and Must have at least two years of professional experience in the practice of law.NOTE:
