Competitive salary based on experience Position Summary We are a recruiting agency assisting one of our clients in the alternative lending / merchant cash advance industry in hiring a Post-Judgment Collection Attorney. The Post-Judgment Collection Attorney will be responsible for enforcing judgments and recovering assets related to defaulted Merchant Cash Advance agreements. This role handles post-judgment litigation and collections, including restraining notices, bank levies, garnishments, asset investigations, settlement negotiations, and court appearances. The ideal candidate will have experience in collections, creditors' rights, commercial litigation, or MCA-related enforcement matters, with strong knowledge of debtor-creditor law and post-judgment procedures. Key Responsibilities Manage post-judgment enforcement matters involving MCA merchants and guarantors. Conduct asset investigations and debtor discovery. Prepare and file legal documents, including: Restraining notices Executions and levies Wage garnishments Property liens Information subpoenas Turnover motions Judgment renewals Coordinate with marshals, sheriffs, banks, process servers, investigators, and outside vendors. Handle supplementary proceedings and debtor examinations. Identify potential fraudulent transfers and concealed assets. Negotiate settlements, workouts, and payment plans. Monitor merchant compliance with settlement agreements. Litigate enforcement-related motions and attend hearings as needed. Domesticate foreign judgments in other jurisdictions when necessary. Collaborate with underwriting, servicing, collections, and recovery teams. Maintain accurate litigation, collection, and recovery records. Ensure compliance with applicable state collection laws, civil procedure rules, commercial finance regulations, and
FDCPA/FCRA
considerations where applicable.
Qualifications Required:
Juris Doctor degree. Active bar license in at least one U.S. jurisdiction. Minimum of 3+ years of experience in collections, creditors' rights, commercial litigation, or related legal practice. Experience enforcing judgments in commercial finance, MCA, or similar matters.
Strong knowledge of:
UCC procedures Bank restraints and levies Commercial collections Debtor-creditor law Post-judgment enforcement procedures
Preferred:
Merchant Cash Advance industry experience. Experience with New York commercial enforcement procedures. Experience in a high-volume litigation or collections environment. Asset tracing and fraud investigation experience. Skills Strong motion drafting and litigation skills. Strong negotiation and settlement strategy. Investigative mindset with attention to detail. Ability to manage a high-volume caseload. Courtroom advocacy experience. Strong organizational and analytical skills. Ability to meet deadlines and maintain procedural compliance. Professional communication skills when working with internal teams, vendors, courts, and opposing parties.
