NEW Solutions connects experienced workers (ages 55+) with the Office of Policy, Management and Budget (PMB). These experienced professionals provide administrative expertise, facilities management, natural and cultural resource planning, and a broad array of other professional skills that support the Office of Policy, Management and Budget through the Experienced Services Program (ESP). Positions listed here do not guarantee employment for any definite period. Enrollment in the Experienced Worker Programs administered by NEW Solutions is temporary. The enrollment relationship between NEW Solutions and the Enrollee is an "at-will" relationship. This means that an Enrollee is free to terminate enrollment at any time during the enrollment period, and NEW Solutions and the Agency have the right to terminate the relationship with the Enrollee.

Duties:
This position will support the Probate Hearings Division Administrative Law Judges (ALJ) and Indian Probate Judges (IPJ) for in-person or virtual hearings. Enrollees will apply the specialized rules of practice of the Department and the OHA in the conduct of hearings; follow processes for case docket management; and utilize a control system to monitor the status of cases. Act as duly appointed master under the supervision of ALJs and IPJs in Indian Probate cases. Administer oaths and affirmations. Conduct on the record evidentiary hearings under the supervision of ALJs and IPJs. 40% Address motions pertaining to the propriety or adequacy of the pleadings involved. Consider testimony and the admissibility of evidence. Address motions involving questions of law and procedure. 20% Regulate the conduct of witnesses, attorneys, and the course of hearings, including examination and cross-examination of witnesses, as necessary for the full development of the record. Hear the oral arguments of the parties, considering their written briefs, and proposing findings of fact and conclusions of law. Perform factual and legal research on a variety of difficult issues in diverse subject areas, where precedents are sometimes not available, and drafting orders, legal memoranda, and decisions. 20% Implement and provide support for modernization efforts including fully implementing the use of electronic filing and case docket management system. 10% While independently conducting hearings of a less complex nature, and ensuring an orderly process which includes eliciting and analyzing testimony, evidence, and pertinent records from the parties, the Attorney-Advisors will make reviewable determinations with respect to whether evidence is material or admissible, witness credibility, or any other rulings or interpretations that are finally binding upon the OHA or the parties. For every recommended hearing outcome, an ALJ or IPJ will be able to review the complete record of decisions leading to that recommendation, which will also be transparent to the parties. The parties will be told that the Attorney-Advisors are not federal government employees and are acting in an advisory and assistive role. The Attorney-Advisors will apply clearly stated procedural and substantive rules within a limited range of discretion under supervision of an ALJ or IPJ. 10%
Qualifications:
J.D. in LLB also acceptable with minimum additional experience of 15 year(s) in attorney roles Experience in probate law a plus but not required Experience required with Windows, MS Word, MS Excel, MS Teams, MS Outlook
