Role:
We are seeking a skilled Law and Motion Attorney specializing in Medical Malpractice and Healthcare Litigation to join our dynamic legal team. This role involves handling strategic, procedural, and technical court work, including drafting and arguing motions, managing complex legal issues, and shaping the outcome of high-stakes medical malpractice cases. The ideal candidate will possess strong litigation skills, a comprehensive understanding of medical and legal principles, and the ability to craft persuasive legal arguments.
Key Responsibilities:
  • Draft and argue a variety of motions including Demurrers / Motions to Dismiss, Motions to Strike, Summary Judgment / Summary Adjudication, Discovery Motions, and Motions in Limine.
  • Analyze issues related to standard of care and causation in medical malpractice cases.
  • Evaluate and challenge expert declarations, identify deficiencies in opposing expert opinions, and draft strategic legal arguments.
  • Navigate complex statutes, including damage caps and procedural rules specific to healthcare litigation.
  • Conduct appellate-level research, citing nuanced case law on standard of care, and prepare technically precise, persuasive briefs.
  • Collaborate with medical experts and understand medical terminology to support legal strategies.
  • Manage the procedural aspects of litigation to ensure cases survive and progress toward trial.
Qualifications:
  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the CA state bar and in good standing.
  • Proven experience in medical malpractice and healthcare litigation, with a focus on law and motion practice.
  • Strong understanding of medical terminology, causation, and standard of care issues.
  • Excellent legal research, writing, and oral advocacy skills.
  • Ability to analyze complex legal and medical issues and develop effective litigation strategies.
  • Experience with expert witness issues, evidentiary objections, and procedural rules in healthcare law.
Preferred Skills:
  • Prior experience in appellate litigation.
  • Background in complex civil litigation.
  • Familiarity with statutes and regulations governing healthcare and medical malpractice.
