Opens a new window. Establish and maintain client contact, providing regular updates & address any concerns. Conduct a comprehensive review of the case file and prepare a case strategy, identifying the strengths and weaknesses of each case. Draft case memos and update as necessary throughout the litigation process. Review and approve government claims; track statutes and all deadlines. Ensure clients receive compassionate, efficient, and effective legal representation, including keeping clients updated w/ the status of their case and managing expectations. Remain accessible for time-sensitive client needs that may occasionally arise outside standard business hours, including evenings or weekends. Handle case advance/loan requests. Propound and respond to written discovery requests. Coordinate w/ the case manager and paralegal to ensure timely and complete responses to written discovery requests. Draft & respond to meet and confer letters as needed to resolve disputes or clarify discovery issues w/ opposing counsel, including but not limited to overbroad subpoenas, deficient discovery responses, etc. Prepare for and conduct depositions of parties, witnesses, and experts. Review, analyze, and summarize deposition transcripts to identify key testimony and develop case strategy. Retain and collaborate w/ appropriate expert witnesses. Manage all aspects of expert discovery, including strategy, report review and analysis, designation, and preparation of expert files, as well as taking and defending expert depositions. Research, draft, & file any & all pre-trial, dispositive, and discovery-related motions, including motions to compel, summary judgment motions, motions in limine, and motions for protective orders. Oppose any motions that are filed on any assigned cases, and work w/ opposing counsel to resolve outstanding issues in those motions. Argue motions in Court, advocating for clients' interests and effectively presenting legal arguments. Attend all hearings for assigned cases and assist other attorneys as needed to cover for any needed appearances. Collaborate w/ head of litigation to determine settlement strategy. Communicate w/ defense counsel and insurance adjusters to negotiate settlements. Prepare clients and cases for mediation, including drafting briefs and actively participating. Meet w/ the trial team approx.150 days out from the trial date & develop a plan to settle, continue or prepare for trial. Consult w/ the trial team and managing partner regarding the selection, retention and preparation of experts for each case that is reasonably required to go through expert designation. Prepare/assist in the preparation of all trial-related documents, including, but not limited to, exhibit lists, witness lists, and trial binders at the direction of the trial team. Participate in all aspects of trial, including, developing overall trial strategy, voir dire, opening statements, direct and cross-examination of witnesses, and closing statements. Familiarize yourself w/ the various medical conditions, treatment options, and procedures. Ensure there are no gaps in medical care, and that clients understand how medical decision making affects their case including the value, the timeline and overall resolution. Build & maintain strong relationships w/ the medical providers. Hold weekly team meetings to address upcoming deadlines, court appearances, address questions and concerns from the team and provide feedback as needed. Supervise and delegate tasks to the case manager and paralegal, providing guidance, feedback, and support as needed. Ensure thorough documentation, ethical compliance, and timely progression. Analyze medical records, challenge unfavorable liability findings, and pursue all potential recovery avenues. Telecommuting permitted, but must come into the office in Costa Mesa, CA as needed.
Requirements:
JD degree. Valid law license in the state of California. 1 year of experience as an Attorney or related role including litigation experience. Ability to manage a caseload independently and collaboratively w/in a team environment. Excellent legal writing and analytical skills. Strong written and verbal communication skills. Strong negotiation skills and ability to evaluate case value. Demonstrate commitment to client advocacy, integrity, and professionalism. Excellent research, communication, and Mediation/negotiation skills. Demonstrated experience handling cases from filing through resolution, including: Drafting and responding to discovery; Taking and defending depositions; Drafting and arguing motions (MTC, MSJ/MSA opposition, motions in limine); Court appearances and CMCs.
Strong working knowledge of:
  • California Code of Civil Procedure
  • California Evidence Code
  • Local Rules (Los Angeles, Orange County, etc., as applicable)
  • Experience preparing cases for trial, including:
  • Trial briefs
  • Exhibit lists
  • Witness lists
  • Jury instructions
  • Trial Experience.
