Job Description
Workers' Compensation Attorney (Defense)Position OverviewWe are seeking a highly skilled Workers' Compensation Attorney (Defense) to join our litigation team. The successful candidate will represent employers and insurance carriers in all aspects of workers' compensation defense, from case evaluation and strategy through trial and appeals. This role requires strong litigation skills, mastery of workers' compensation law, and the ability to manage a high-volume caseload while delivering excellent client service and achieving favorable outcomes.
Key ResponsibilitiesProvide defense counsel in workers' compensation claims for employers and insurance carriers, including hearings, mediations, trials, and appellate matters.
Manage a caseload from intake through resolution: evaluate claims, develop defense strategies, draft pleadings, prepare discovery, depose witnesses, and manage evidence and exhibits.
Conduct legal research and analyze statutes, regulations, case law, and medical records to support defense positions and anticipate opposing arguments.
Prepare and present motions, briefs, and trial memoranda; advocate effectively before administrative law judges, arbitrators, and appellate bodies.
Negotiate settlements when appropriate, advising clients on risks, costs, and potential outcomes to achieve efficient and cost-effective resolutions.
Work closely with claims professionals, adjusters, medical experts, vocational specialists, and outside counsel to coordinate defense strategy and ensure cohesive case management.
Maintain accurate, timely case files, billing records, and client communications; meet firm and ethical deadlines and reporting requirements.
Provide training and guidance to less experienced attorneys and staff on workers' compensation defense strategies, courtroom procedures, and best practices.
QualificationsJuris Doctor (JD) from an accredited law school and active bar admission in California; good standing required.
Minimum of 3+ years of experience practicing workers' compensation defense or related litigation; preference for candidates with extensive hearing/trial experience.
Demonstrated litigation skills including motion practice, witness examination, trial advocacy, and appellate briefing.
Strong knowledge of workers' compensation statutes, regulations, medical and vocational concepts, and administrative procedures relevant to defense practice.
Excellent written and verbal communication, legal research, and client counseling skills; ability to present complex medical and legal concepts clearly.
Proven ability to manage a high-volume caseload, prioritize tasks, and meet deadlines while maintaining attention to detail.
Comfortable conducting depositions, cross-examinations, and arguing before administrative tribunals and courts.
Professional demeanor, ethical standards, and commitment to client service; strong interpersonal skills for working with clients, experts, and colleagues.
Experience with legal case management software and basic proficiency in office technology; willingness to travel to hearings and depositions as required.
