MUNICIPAL COURT CLERK

Job Description

The overall purpose and general responsibilities of the job are to perform the administrative duties of the Municipal Court Clerk. This position is responsible for the administration and clerical duties involving court records and legal documents, processing payments, issuing receipts, input citations, issue warrants, trial court scheduling and provides support services to the Municipal Judge, Prosecutor and City Administrator. Is under the general direction of the Presiding Judge and City Administrator.

ESSENTIAL JOB FUNCTIONS
The fundamental duties and tasks that define the job. (The following examples are intended to be illustrative and are not intended to be all inclusive.) Administers and supervises the activities of the Municipal Court office which includes managing and scheduling court dockets, document preparation, records management, and fine/bond collection; Receives all incoming calls and emails for the Municipal Court providing information to Violators and Defense Attorneys; Serves as the cashier for the court, receiving payments, providing receipts, documenting collections received, submitting collections to the City Treasurer for deposit, clearing cases outstanding with American Municipal Services and Omnibase when necessary; Monitors ticket writing, communicates with the Presiding Judge, Prosecutor and Police Department for new arraignments; Data entry of all citations, create new violation codes and fine/fee structures, when necessary; Prepare and maintain docket, issue summons, draft complaints, judgements, initial court setting letter and bill of costs, jacket labels and prepare case files; Monitors all outstanding arrangements, collections and recommends outstanding cases for show cause hearing, prepare show cause hearing notice, assign case to a show cause docket; Prepares documents for arraignments, extensions, time payments, defensive driving, deferred disposition, indigent arrangements and community service order for Presiding Judge approval; Assist Presiding Judge, Prosecutors, Violators and Attorneys in courtroom, monitors and coordinates courtroom activities; Receives Attorney Appearance Bonds and Violator Cash Bonds and assigns case to a docket; Process Attorney Appeal Bonds and submits cases to the Montgomery County Clerk s Office; Corresponds with Bond Companies and Montgomery County Jail; Processes Violator credit for time served requests, probation, payment arrangements and requests for trials, preparing documents for the Presiding Judge and Prosecutor; Data entry of all dispositions after arraignment in Intouch and Excel maintaining accurate records; Coordinates pretrial, bench and jury trial appearances, drafting subpoenas, selects prospective jurors, prepares the necessary documentation for the Violator, Defense Attorney, Prosecutor, Presiding Judge and Police Department; Preparation of notifications of violation of promise to appear warrants, complaints, issue violation of promise to appear warrants, capias pro fine warrant judgements, complaints, issues capias pro fine warrants under the Presiding Judge s direction; Preparation of outstanding warrant case files for the Police Department. Monitor juvenile Violators and communicate with legal parent or legal guardian; Monthly transmit new active warrants to Omnibase and American Municipal Services; Monthly transmit cleared warrants to Omnibase and American Municipal Services; Monthly preparation of the Office of Court Administration report for the City Administrator; Monthly preparation of the Court Activity Report; Weekly transmit the Conviction Report to the Texas Department of Public Safety; Daily reconciliation of the Daily Cash Report; Monthly transmit Driver History; Report; Serves as custodian of court records, processes motions for discovery and maintains the Court Seal and handles highly confidential information; Perform other related duties as required; Serve as back up to City Secretary/Building Permit Clerk/Code Enforcement Clerk.
