Temporary, full-time Worksite / Area of Intended Employment Primary worksite/reporting location: 410 Elm Forest Loop, Cedar Creek, TX 78612, Bastrop County. Work will also be performed at various customer worksites within the Austin-Round Rock-San Marcos, TX Metropolitan Statistical Area. Travel to worksites within the area of intended employment will be frequent during the high season of need and will depend on customer demand and weather. Workers will report to the designated reporting location and will be transported with the crew to the jobsite(s) as needed. Job Duties Landscape or maintain grounds of property using hand or power tools or equipment. Workers typically perform a variety of tasks, which may include any combination of the following: sod laying, mulching, mowing, trimming, planting, watering, fertilizing, digging, raking, sprinkler installation, installing rock, installing granite, and weed control application. Tools/Machines used- mini x, skid steer, hydroseeder, trencher, sod roller, big wheel loader, shovels, hammers, pipe cutters, wheelbarrows, wire locaters, PVC glue/fittings. Minimum Requirements No minimum education required. No training required. No experience required. No special skills, licenses, certifications, or foreign language requirements. The position does not supervise other employees. Work Schedule Monday through Friday, 6:00 a.m. to 5:00 p.m. Occasional Saturdays may be available and/or required depending on workload, weather, and customer demand. Anticipated hours: approximately 50-60 hours per week. Work schedule and hours may vary based on weather, workload, and business needs. Wage Employer will pay at least $18.93 per hour. Employer will pay the highest of the offered wage, the prevailing wage, the applicable federal, state, or local minimum wage, or the actual wage paid by the employer to other workers with similar experience and qualifications for the position in the same location, if higher. Overtime may be available and/or required. Any hours worked over 40 in a single workweek will be paid at no less than $28.40 per hour. Employer will use a single workweek as its standard for computing wages due. Workers will be paid weekly. Deductions Employer will make all deductions from the worker's paycheck required by law. No deductions not required by law will be made. Board, Lodging, and Other Facilities Employer does not provide housing, board, lodging, or other facilities and will not deduct any amount for housing, board, lodging, or other facilities. Tools, Supplies, and Equipment Employer will provide, without charge or deposit charge, all tools, supplies, and equipment required to perform the duties assigned. Transportation and Subsistence If the worker completes 50 percent of the period of employment covered by the job order, employer will provide or reimburse the worker for transportation and subsistence- the place from which the worker has come to work for the employer, whether in the United States or abroad, to the place of employment, consistent with 20CFR 655.20 If the worker completes the period of employment covered by the job order, or if the worker is dismissed from employment for any reason before the end of the period and the worker has no immediate subsequent H-28 employment, employer will provide or pay at the time of departure for the worker's cost of return transportation and daily subsistence from the place of employment On the job training will be provided. to the place from which the worker departed to work for the employer, consistent with 20 CFR 655.20. Daily subsistence during required travel will be provided or reimburse ed, at a rate of at least $16.78 per day and up to $68.00 per day with documentation of actual expenses. Employer will provide or pay reasonable lodging costs where lodging is necessary during inbound or outbound travel. All employer-provided transportation will comply with all applicable federal, state, and local laws and regulations. Visa and Related Fees Employer will pay or reimburse the H-2B worker in the first workweek for all visa, visa processing, border crossing, and other related fees, including those mandated by the government, incurred by the H-28 worker, but not passport expenses or other charges primarily for the benefit of the worker. Three-Fourths Guarantee Employer will guarantee to offer employment for a total number of work hours equal to at least three-fourths of the workdays in each 12-week period, and, where applicable, each 6-week period, in accordance with 20 CFR 655.20(f). Equal Terms and Conditions Employer will provide U.S. workers in corresponding employment no less than the same benefits, wages, and working conditions offered to H-2B workers. Employer will not offer H-2B workers better wages, benefits, or working conditions than those offered to U.S. workers in corresponding employment. Other Assurances Employer is covered by unemployment insurance. Employer is covered by workers, compensation insurance. No strike, lockout, work stoppage, slowdown, or interruption of operations exists at the place of employment. No arrangements have been made with any establishment owner or agent for the payment of commissions or other benefits for sales made to workers.
