Job Description

Claims Litigation Attorney This position acts as counsel to policyholders and the Exchange in all legal proceedings, including trial and arbitration. It provides legal representation of policyholders to protect their interests in defense of personal injury and/or property damage lawsuits. This includes defense of complex litigated homeowners, personal injury and property damage lawsuits with moderate to occasionally higher exposure. This position provides assistance on the handling of other attorneys' files, which may include providing guidance to lesser experienced attorneys. Responsibilities Analyzes cases to determine all pertinent facts and develop appropriate legal theories/strategies in the defense of lawsuits. Develops and implements appropriate discovery plans and motions, as needed. This includes propounding and answering written discovery, subpoenas, and review of records, taking depositions, drafting and opposing motions, retaining and conferring with experts, and obtaining witness statements. Prepares for, attends and defends all court proceedings related to cases including trials in moderate to occasionally higher exposure cases. Will also prepare for, attend and defend mediations and arbitrations. Researches and prepares motion, trial and appellate briefs and argue motions, and appeals before all appellate courts. Identifies issues of liability and damages, sets forth legal defenses and strategy recommendations, and if requested provides opinions on value or any other pertinent information. Work is both highly specialized and varied requiring careful, proven and strong drafting research, analytical, negotiation, problem solving, and decision making skills - including the ability to balance and reconcile competing legal and claims considerations and to prioritize tasks. Legal decisions and judgment must often be made in uncertain situations that lack clear legal precedent and under tight deadlines. Work requires excellent oral and written communications skills, trial and arbitration skills, deposition and other civil discovery skills, excellent teamwork, initiative and client relationship skills, and a commitment to ethical conduct. Qualifications JD Required 7-9 years Insurance defense law Required Thorough understanding of insurance contracts. Firm grasp of trial procedures and the rules of the evidence. Valid Driver's License, acceptable Department of Motor Vehicles record and minimum liability insurance - Issued by State Required #LI-LG1 The starting pay range for this position is: $132,600.00 - $176,900.00 Additionally, for full time positions, you will be eligible to participate in our incentive program based upon the achievement of organization, team and personal performance. .
