Job Description
PURPOSE OF CLASSIFICATION
Assists the District Attorney as one of the representatives of the State of Georgia in the Superior Court of Clayton County. This is a highly responsible, professional position that will act as a resource and mentor for Assistant District Attorneys, Senior Assistant District Attorneys, and Senior Litigation Assistant District Attorneys, in the preparation for trial, at trial, and post-trial proceedings. Work involves highly varied and complex legal procedures coupled with extensive professional knowledge of Georgia Law and police practices, policies, procedures, and techniques. Work demands independent judgement and initiative. Work is reviewed by the District Attorney.ESSENTIAL FUNCTIONS
The following duties are normal for this position. Other duties may be required and assigned. Represents the State of Georgia in more complex cases; counsels and advises Assistant District Attorneys and Senior Assistant District Attorneys in all matters, especially in complex cases in the pre-trial stages, at trial, and in appellate matters. Prosecutes major violent felonies including murder, rape, and child molestation; assists investigations at outset, to grand jury, to motions, to trial, and any motion for new trials. Acts as advisor to the District Attorney in the development and implementation of policies and procedures for the office. Researches case law, writes briefs, and keeps abreast of the most recent case law and statutory provisions applicable to cases handled in the office. Drafts accusations and indictments and advises department personnel in this procedure. Argues appellate motions in the Georgia Court of Appeals and Supreme Court and the United States District Court and Court of Appeals. Conducts preliminary hearings and negotiates pleas; makes bond recommendations with defense counsel. Advises less-experienced staff members in the formulation of sentencing recommendations. Interviews investigating officers and witnesses and prosecutes assigned cases in court, including Superior, Juvenile, and Magistrate Courts. Drafts and advises in the drafting of discovery documents and responses, pleadings, motions, and judgments. Evaluates and aides less experienced staff members in the evaluation of the merits of criminal cases and determines what further action will be taken. Aids appropriate County or State attorneys in the representation of the custodian in Habeas Corpus matters. Evaluates and advises in the evaluation of certain aspects of pending cases, recommending bond amounts, and recommending bond amounts to the court. Assists citizens, law enforcement personnel, and attorneys in legal matters under appropriate circumstances. Periodically instructs other prosecuting and defense attorneys, and non-attorney staff members within and outside the County. Manages the caseload for the efficient flow between the Investigators and Assistant District Attorney. Supervises Juvenile Court scheduling and fills in for the supervising Juvenile Court Prosecutor. Participate in community outreach programs such as "Back to School" programs, mock trial programs, and Law Day seminars.ADDITIONAL FUNCTIONS
Performs other related duties as required and assigned.MINIMUM QUALIFICATIONS
Juris Doctorate Degree supplemented by five (5) years of previous experience that includes litigation and criminal law with an emphasis on prosecutorial experience or comparable felony trial experience with demonstrated effective and progressively proficient work as an attorney and proficient legal performance in a supervisory role; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job. Requires a demonstrated knowledge and respect for the Code of Professional Responsibility of the State Bar Association of Georgia and participated in the training of other attorneys; completed a minimum of fifteen (15) briefs to the Georgia Court of Appeals or the Supreme Court of Georgia; conducted at least twenty-five (25) jury trials in the Superior Court of Clayton County, which must include a trial of a seven deadly crime, such as murder, rape, and armed robbery, and domestic violence prosecutions as well as others. Must possess and maintain a valid membership in good standing in the State Bar Association of Georgia, the Court of Appeals of the State of Georgia, and the Supreme Court of the State of Georgia. Must possess and maintain a valid Georgia driver's license. A recommendation by the District Attorney is needed for promotion to this classification.ADA COMPLIANCE
