  • Arizona has a requirement for Law Clerk services to support litigation caseload.
The mission of the United States Attorneys is to serve as the nation's principal litigators under the direction of the Attorney General. There are 93 United States Attorneys stationed throughout the United States, Puerto Rico, the Virgin Islands, Guam, and the Northern Mariana Islands The Contractor personnel must have a J.D. law degree and at least two years of professional work experience. These services provided by the Contractor are considered bona fide professional services of a nature closely associated with inherently government functions. As such, the Executive Office for the United States Attorneys' Offices (EOUSA) Acquisitions Staff shall issue and administer this requirement on behalf of the USAO. "This job is a civilian position and does not require military service (including commission and enlistment)."

SCOPE OF WORK
The Law Clerk I:
Works with the assigned AUSAs and/or supervisory attorneys to determine applicable administrative statutory and regulatory law, and identify possible defenses, violations or causes of action. Develops an understanding of all applicable federal, state, or local laws and keeps abreast of any new criminal and civil rules and procedures. Alerts AUSAs to all potential issues while conducting reviews and analyzing and interpreting data within the case file. Assists with regard to 28 USC §2255 (habeas corpus) and immigration habeas matters including, but not limited to: receiving and docketing same, calendaring due dates, contacting appropriate AUSA/Support Staff regarding locating files necessary to drafting responses; preparing a draft response for review by appropriate AUSA; and attending to timely filing of responses. Incumbent analyzes statutes, legislative intent, judicial precedents, agency rules and regulations, and law review articles as they relate to assigned cases to include those of an especially complex or unprecedented nature. Supports AUSA by briefing attorney on pertinent facts, issues and case law. Drafts correspondence and legal documents for attorney's signature. Drafts proposed orders for signature of judges and magistrates.
BASIC QUALIFICATIONS
The Contractor shall provide a candidate that possesses the following qualifications: Law Degree (J.D.) U.S. Citizenship and ability to obtain adjudication for the requisite background investigation Must have valid State driver's license Minimum two (2) years of professional work experience Proficient in Microsoft Office applications Ability to make responsible decisions on short notice and adapt to unexpected developments Physically located within the general geographic commuting radius of the USAO office Working knowledge of the Federal Rules of Civil and Criminal Procedure . Experience and expertise in performing the requisite services in Section 35 HOURS
OF PERFORMANCE
Full-time. No defined work schedule is assigned. The Contractor personnel shall be available on an as-needed basis which may include evenings, weekends and holidays. No premium pay shall be provided for evenings, weekends and holidays. No overtime is anticipated and shall not be authorized without prior approval from the Contracting Officer. A list of Federal holidays observed by the Government on which Federal offices will be closed is as follows: New Year's Day, Martin Luther King's Birthday, Presidents' Day, Memorial Day, Juneteenth Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, and Christmas Day.
