This role navigates the full lifecycle of real estate assets while actively managing portfolio recovery, default resolutions, and collections within the Merchant Cash Advance (MCA) industry. You will act as a strategic advisor to our executive team, overseeing complex acquisitions and compliance alongside aggressive debt recovery and litigation management. Core Responsibilities Transaction Management Own the entire real estate closing process, including drafting and negotiating Letters of Intent (LOIs), Purchase and Sale Agreements (PSAs), and escrow fund flows. Lead exhaustive due diligence, including title commitments, ALTA surveys, Phase I/II environmental reports, and zoning verifications. Oversee land use, municipal approvals, property management agreements, and tenant estoppel certificates. MCA Collections & Recovery Management Direct default and recovery efforts for non-performing Merchant Cash Advance (MCA) agreements. Draft and execute collection strategies, including pre-litigation demand letters, settlement agreements, restructures, and forbearance agreements. Lead enforcement actions, frozen asset negotiations, bank levies, post-judgment collection proceedings, and personal guarantor enforcement. Manage third-party collection agencies, specialized recovery vendors, and external collections counsel to maximize recovery yields. General Legal & Litigation Oversight Lead real estate and commercial collections litigation, managing external counsel across multi-state jurisdictions. Ensure strict regulatory compliance with state/federal lending statutes, Florida-specific real estate laws, and landlord-tenant regulations. Utilize LexisNexis/Westlaw to provide strategy on emerging property law, land use, and commercial debt collection precedents.
Qualifications Education:
Juris Doctor (JD) from an accredited law school.
Licensure:
Active license to practice law in Florida.
Experience:
5-10+ years of dedicated real estate law experience combined with direct legal experience in the MCA or alternative business financing sector.
Collections Expertise:
Proven track record of successful debt recovery, post-judgment enforcement, and default workout negotiations in high-volume or high-value commercial portfolios.
Closing Expertise:
Proven track record of closing high-value commercial real estate transactions.
Mindset:
Practical, solutions-oriented approach with the ability to operate independently in a fast-paced environment. Preferred Experience Prior in-house experience at a real estate firm, MCA funder, or commercial financing entity. Deep familiarity with UCC filings, Confessions of Judgment (COJs), and enforcement mechanics unique to alternative business funding. Direct experience working with executive teams, underwriters, and external recovery partners. This is not a remote position, must be available to work in office Mon - Fri.

$100,000.00 - $200,000.00 per year
