Job Description

Posting Details The Financial Institutions Division of the Regulation and Licensing Department licenses and regulates financial entities within its jurisdiction, promotes a safe and sound financial and economic environment, and safeguards consumer rights. Interviews are anticipated to be conducted within two weeks of closing date. Why does the job exist? The Financial Institutions Division Attorney position primarily provides legal advice to the Director/Deputy Director of the Financial Institutions Division and legal support to the Division as a whole. The attorney in this position also reports to the Chief General Counsel for the Regulation and Licensing Department and may occasionally be called upon to provide support/assistance to the Department or other divisions of the Department as necessary. How does it get done? The Division Attorney provides legal advice, counsel, and other legal services to the Financial Institutions Division Director, Deputy Director, and other FID personnel. The incumbent will, among other duties: study, interpret and apply laws, court decisions, and other legal authorities; prepare legal documents, pleadings, memoranda, reports, opinions, and other materials; process request to inspect public records; intake, investigate, and prosecute administrative violations; draft administrative rules and coordinate their implementation; draft and/or review agency initiated/backed bill language; and provide legal representation in judicial proceedings is state and federal courts. Must be able to regularly/daily operate a provided state vehicle for purposes of essential travel to/from inspection sites and other locations as necessary to carry out the duties of the position. Who are the customers? The Director of the Financial Institutions Division in furtherance of the Division's mission and goals. As the needs of the Regulation and Licensing Department may require, this position may also provide legal counsel or other assistance to the Regulation and Licensing Department or other divisions of the Department when assigned by the RLD Chief General Counsel. Minimum Qualification Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license. Employment Requirements All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA). Candidate must possess and maintain a valid Driver's License and current Defensive Driving Course Certification from the State of New Mexico; or must obtain a Defensive Driving Course Certification within six (6) months of hire as a condition of continued employment. Pre-employment background investigation is required and is conditional pending results. Working Conditions Work is performed in an office setting with exposure to visual/video display terminals (VDT) and extensive personal computer and phone usage with extended periods of sitting. Must be able to lift 25 lbs. Limited in-state and out-of-state travel may be required on occasion. It is anticipated the person in this position will hold a valid driver's license and be able to lawfully operate a state-owned motor vehicle when necessary. Must be able to regularly/daily operate a provided state vehicle for purposes of essential travel to/from inspection sites and other locations as necessary to carry out the duties of the position.
