The Audit and Compliance Division (ACD) enforces compliance with New Mexico tax laws. ACD employs a variety of tax research tools to analyze tax data to improve efficiency, streamline processes, improve customer service, and to develop new compliance programs and tax collection initiatives. ACD promotes voluntary compliance of registering, filing, and paying taxes by educating taxpayers, promoting managed audits. The purpose of this position is to examine, analyze and interpret tax accounting records for the purpose of determining compliance with federal and state laws, statutes, rulings and regulations, and generally accepted accounting and auditing standards; complete tax audits of corporations, businesses and individuals; prepare and presents audit reports. This position offers the opportunity to work both independently and as part of a collaborative team, supporting a variety of tax programs driven by business needs. The role is based in Albuquerque and relies on the communication tools and resources available to effectively serve New Mexico taxpayers. The purpose of this position is to examine, analyze and interpret source documents to determine compliance with applicable Federal and State regulations. Tax Auditors prepare and present reports of findings and recommendations to management, directors, or legislators. The Tax Auditor has some latitude for independent judgment and may vary work methods and procedures, within prescribed parameters. Work is usually performed under general supervision. Work is frequently of some variety and incumbent may set priorities. How does it get done? The occupation of Tax Auditor requires independence, complex analytical skills, and mastery of applying professional laws and standards sufficient to conduct complex assignments involving interfaces and interrelationships between and among programs, systems, functions and policies. They communicate with entities being audited, Certified Public Accountants (CPAs), attorneys, employees, managers, customers, legislators and other agencies. In-state and/or out-of-state travel may be required. Tax Auditors schedule audits; conduct analyses and inspections, and review operations and/or records; prepare and present reports of findings and recommendations to management, directors, or legislators; prepare audit working documents by examining, reviewing, and analyzing accounting, and inventory records. Tax Auditors monitor follow-up on implementation or corrective actions; audit information system development, data processing administration and maintenance, computer control and operations, and/or management controls in an electronic data processing environment. Tax Auditors provide guidance, direction and interpretation of federal and state statutes, regulations, and Department policies to all taxpayers, information system development, data processing administration and maintenance, computer control and operations, and/or management controls in an electronic data processing environment. Communication:
Annotate GenTax with all taxpayer correspondence. Answer taxpayer inquiries and provide guidance to less experienced staff members regarding taxpayer inquiries via phone, fax, and email. Emails, Calls, and Voicemail and Return calls from messages within 24-48 hours in a regular working week. Communicate with entities being audited, certified public accountants, attorneys, employees, managers, customers, legislators and other agencies. In person appointments for taxability questions. Keeps taxpayers and/or taxpayer representatives, to include CPAs and attorneys, informed and apprised of all phases of the tax audit process with supervisor assistance. Listens effectively and clarifies information as needed. Makes point of view in a clear and convincing manner. Writes in a clear and concise manner. Research and Analysis of Law Assist Legal Services Bureau in legal matters related to audits, to include participating in informal and formal conferences, providing depositions, and/or testifying at hearings and/or District Court. Interprets and applies federal and state tax statutes, rules, policies and regulations alongside supervisors. Reviews and analyzes contracts to determine tax liability or other tax-related issues. Research, drafts, interprets and applies laws, regulations, statutes, accounting/auditing procedures and program policies. Independently reviews and analyzes contracts to determine tax liability or other tax-related matters. Analyzes, interprets, and applies appropriate tax laws, regulations, and rulings to situations revealed during course of audit. Internal Controls Evaluate taxpayer accounting systems and internal controls for accuracy and completeness. Audit Planning Assist in planning the course of action for auditing the taxpayer. Discusses with supervisor audit selection, tax audit plan, appropriate tax laws, regulations, and rulings during phases of the tax audit. Conduct Audits Participate in and conducts tax audits of small to moderate sized businesses or individual taxpayers, independently or as a member of an audit team. Reviews audit packages, to include narratives and schedules of subordinates to assure accuracy of conclusions and opinions. Sampling Discusses with supervisor audit sampling plans and the application of sampling techniques. Prepare reporting Clearly explain the Audit/Refund/ Abatement process, findings, statutes, regulations, and rulings within the narrative. Prepares audit reports to include narratives and schedules and submit audit results to supervisor for further review and action. Special Investigations May conduct or assist in special investigations of individual or business tax accounts. Training Attend in person or virtual trainings. Conducts workshops and seminars for external customers. Special Project GenTax Testing. Outreach for compliance. Participates in legislative bill review process. Participates in the development of tax system specifications, testing, and implementation. Special projects. Subject Matter Expertise for special projects. Safety Provide in-person safety duties. Verify evacuation routes. Security Maintain clean desk policy. Maintain security controls pursuant to the IRS publication 1075 (all employees with GenTax access). Secure all paper documents in dual locked containers. Who are the customers? Minimum Qualification Bachelor's Degree in Accounting, Finance, Business Administration, or Taxation to include twelve (12) semester hours of accounting or auditing (three (3) semester hours in finance or business law may substitute for up to three (3) semester hours of accounting or auditing). Four (4) years of experience in Auditing, Accounting, Taxation, Collections, or Finance may substitute for the required Bachelor's degree. Employment Requirements Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification within six (6) months of date of hire as a condition of continued employment. Must be current with all tax reporting/payment. Employment is subject to post offer pre-employment criminal background check to include fingerprint checks and is conditional pending results Working Conditions Office setting, exposure to VDT, extensive personal computer and phone usage. Extended periods of sitting and some lifting. Good communication skills; Interacting with the public required. High pressure/stress situations. Some outdoor work may be required.
