SUMMARY The Contractor Labor Compliance Analyst performs the day-to-day administrative, analytical, auditing, and field-verification work necessary to support the Company's contract labor compliance program. The position reviews contractor qualifications, maintains compliance records, monitors expirations, audits timekeeping and payroll documentation, documents exceptions, and follows corrective items through resolution. The Analyst works closely with the Contractor Labor Compliance Manager, farm labor contractors, staffing agencies, Operations, Time and Attendance, Payroll, Accounts Payable, Safety, Human Resources, and other departments. The position supports agricultural operations involving grapes, citrus, kiwi, harvesting, packing houses, cold storage, and related activities. Reporting Relationship The Contract Labor Compliance Analyst reports directly to the Contract Labor Compliance Manager.
ESSENTIAL DUTIES AND RESPONSIBILITIES
Contractor Qualification and Onboarding Collect and review contractor intake information, legal-entity documentation, tax forms, ownership information, contact information, and other materials required for contractor evaluation and onboarding. Verify current California and federal farm labor contractor licenses and registrations, applicable county registrations, bonds, permits, and authorizations relating to recruiting, housing, transportation, driving, or other regulated activities. Collect and review insurance certificates and required endorsements, including commercial general liability, automobile liability, workers' compensation and employers' liability, employment practices liability, additional-insured status, primary and noncontributory language, waiver of subrogation, and alternate-employer coverage when required. Track completion of the Services Agreement, Work Authorizations, required exhibits, acknowledgments, personal guaranties, transportation documents, vehicle information, and other onboarding requirements. Identify missing, expired, inconsistent, or potentially unacceptable documentation and communicate routine documentation requirements to the contractor or appropriate internal personnel. Verify completion of the required onboarding checklist, including documentation, PickTrace equipment issuance, orientation, training, and written work authorization, and promptly notify the Manager of any contractor that appears scheduled to begin work before all requirements have been satisfied. Prepare contractor qualification and onboarding files for management review and approval. The Analyst does not independently approve or authorize a contractor to begin providing services. Licensing, Insurance and Expiration Monitoring Maintain accurate contractor files and a reliable compliance calendar for licenses, registrations, bonds, insurance policies and endorsements, agreements, training requirements, and other expiration or renewal dates. Provide advance renewal notices, obtain updated documentation, and review whether entity names, coverage information, effective dates, limits, and other information correspond with established requirements. Use government databases and other authorized sources to verify licensing, registration, permit, or authorization status and retain supporting verification records. Identify and escalate missing, expired, inconsistent, or potentially unacceptable documentation to the Manager or other designated personnel. Prepare periodic status reports identifying active and pending contractors, upcoming expirations, documentation deficiencies, outstanding corrective actions, and unresolved compliance concerns. Timekeeping, Payroll and Invoice Audits Compare PickTrace time, attendance, meal-period, production, piece-rate, and nonproductive-time records against contractor payroll registers, wage statements, invoices, and supporting documentation. Review selected records for compliance indicators involving minimum wage, overtime, meal- and rest-period premiums, reporting time, piece-rate and hourly compensation, nonproductive time, deductions, rates, hours, employee counts, and other assigned audit criteria. Identify missing records, unexplained variances, duplicate or proxy scans, rounding, unapproved manual entries, zero-production anomalies, invoice discrepancies, and other exceptions requiring additional review. Document the audit scope, samples, evidence reviewed, findings, contractor explanations, potential amounts requiring correction, response deadlines, and supporting proof of resolution using approved forms and systems. Request additional records or explanations in accordance with the applicable Services Agreement, Work Authorization, audit plan, or established Company procedure. Prepare factual findings and recommended corrective actions for review by the Manager or other authorized personnel. Coordinate with Time and Attendance, Accounts Payable, Payroll, Operations, and the Manager to reconcile records, verify approved corrections, and identify opportunities to prevent recurrence. Field Verification and Compliance Monitoring Conduct scheduled and unannounced field or facility visits using approved checklists, protocols, and escalation procedures. Verify crew rosters, worker identities and badges, self-scanning practices, meal-period scans, assigned activities, production recording, required postings, training records, and compliance with applicable site rules. Observe and document contractor supervision, onboarding practices, worker transportation, vehicle and driver information, and other assigned compliance areas without directing contractor employees or assuming the contractor's employer responsibilities. Document field observations objectively, preserve relevant supporting information, and promptly communicate identified deficiencies or exceptions to the Manager or designated Company representative. Immediately report urgent safety concerns, suspected retaliation, wage-and-hour violations, harassment, human trafficking, worker coercion, child labor, falsification, threats, or other serious concerns through established Company channels. Complaints, Investigations and Corrective-Action Support Receive contractor-worker questions or complaints professionally, document the information provided, preserve relevant records, and promptly notify the Manager or designated Human Resources representative. Avoid promising a particular outcome, conducting an unauthorized investigation, providing legal advice, or representing that the Company has reached a final determination. Assist with interviews, document collection, chronology preparation, factual summaries, payroll reconstruction, and other investigation activities as assigned. Prepare draft requests for information, compliance notices, corrective-action trackers, chargeback support, and closure documentation for management review and approval. Monitor contractor response deadlines and obtain documentation supporting promised corrections, payments, training, or process changes. Verify and document whether requested information or corrective-action evidence has been received and escalate overdue, insufficient, disputed, recurring, or potentially significant matters. Compliance Review, Follow-Up and Escalation Review contractor documentation, audit results, field observations, complaints, and corrective-action records for completeness, consistency, and potential compliance concerns. Communicate routine documentation deficiencies and follow up with contractors and internal departments regarding outstanding records, explanations, and corrective-action items. Flag incomplete or deficient contractor files and, when permitted under established procedures, pause further administrative processing pending receipt of required information or management review. An administrative processing hold does not authorize the Analyst to suspend contractor operations. Document compliance concerns, contractor responses, recommended corrective actions, and matters requiring management review in the appropriate tracking system or contractor file. Prepare findings and recommendations for management consideration regarding contractor qualification, work authorization, compliance status, chargebacks, invoice or payment matters, suspension, or termination. Obtain management approval before communicating or implementing any final decision involving contractor work authorization, compliance status, chargebacks, payment, nonpayment or withholding, suspension, or termination of the contractor relationship. Immediately escalate suspected falsification, retaliation, threats, worker coercion, serious safety concerns, systemic wage-and-hour issues, government inquiries or enforcement activity, or other matters presenting significant legal, financial, operational, or reputational risk. Maintain confidentiality and refrain from making commitments, legal interpretations, or final compliance determinations outside the position's assigned responsibilities and delegated authority. Records, Reporting and Program Support Maintain complete, accurate, and organized contractor files, audit workpapers, training records, field-visit records, correspondence, complaints, findings, corrective-action records, and closure documentation. Enter and maintain compliance information in designated systems, trackers, calendars, and reporting tools. Prepare dashboards, exception reports, trend summaries, contractor status reports, and other recurring or ad hoc reports for management. Support agency inspections, audits, claims, subpoenas, and document requests by locating, preserving, and organizing potentially responsive records under the direction of management or legal counsel. Assist with contractor meetings, orientations, compliance training, procedural updates, special projects, and process-improvement initiatives. Perform other duties consistent with the position's purpose and level of responsibility as assigned. Required Qualifications Two or more years of experience in human resources, contractor compliance, payroll, timekeeping, auditing, accounts payable, agricultural operations, or a related compliance function. Working knowledge of payroll and timekeeping concepts and the ability to compare multiple records, identify discrepancies, and document findings accurately. Experience with farm labor contractors, seasonal agricultural employment, harvesting, packing, food production, or another regulated labor environment is strongly preferred. Strong attention to detail, follow-through, professional judgment, and ability to handle sensitive information confidentially. Proficiency with Microsoft Excel, Word, Outlook, document-management systems, and timekeeping or payroll systems; experience with PickTrace is preferred. Valid driver's license, acceptable driving record, and ability to travel regularly among Company and contractor work locations. Education Associate or bachelor's degree in human resources, business, accounting, labor relations, agriculture, or a related field is preferred. Substantial directly related experience may be considered in place of a degree. Language Professional fluency in English and Spanish is strongly preferred because the position regularly communicates with contractors, supervisors, and workers in a bilingual agricultural environment. Work Environment and Schedule Work is performed in office, packing house, cold storage, field, ranch, and other agricultural settings, with exposure to operational noise, dust, dirt, uneven terrain, moving equipment, heat, cold, and changing weather conditions. The position requires regular travel among Company locations and contractor work sites throughout Kern, Tulare, Fresno, and other counties in which the Company operates. The schedule may vary based on harvests, packing operations, contractor activity, audits, complaints, investigations, agency activity, or other business requirements. Early-morning, evening, weekend, or extended hours may occasionally be required. Appropriate personal protective equipment and compliance with all site-specific safety and food-safety requirements are required when entering operational areas. Physical Requirements Frequently communicates in person, by telephone, and through electronic systems; reviews detailed records; and uses a computer for extended periods. Regularly walks and stands in offices, packing facilities, and field locations and may traverse uneven, wet, dusty, or unpaved surfaces. Occasionally lifts or carries files, supplies, or equipment weighing up to 25 pounds. Must be able to travel by vehicle between work locations and perform the essential functions of the position, with or without reasonable accommodation.
