Hearing Officer (DWS #9433) State of New Mexico - 3.5 Albuquerque, NM Job Details Full-time $33.12 - $49.68 an hour 9 hours ago Qualifications Driver's License Full Job Description Posting Details The Appeals Tribunal is part of the Department of Workforce Solutions,Unemployment Insurance Division. The Tribunal conducts administrative hearings over the phone for appeals filed against determinations issued by DWS related to the administration of unemployment. Interviews for this position will be conducted within 10 business days of posting closure. Due to budget restraints, this position will pay $33.12 hourly. Why does the job exist? Hearing Officers conduct appeal hearings over the phone to decide whether the determinations issued by the Claims Division are lawfully made. During the hearing, the Hearing Officer will gather testimony and evidence from both employers and claimants and will issue a decision containing findings of fact and conclusions of the law based on the information obtained during the appeal hearing. The Hearing Officer will collect, organize and analyze factual information to determine the legal effect in the context of applicable federal and state laws. Consider evidence and testimony, objections, motions, and other requests. Determine appropriate courses of action needed to manage time efficiently, maximize productivity, ensure accuracy and comply with deadlines. How does it get done? Hearing Officers conduct telephonic hearings whereby the parties present witness testimony and evidence, cross examine opposing parties and give argument in support of their positions. They will issue decisions based on the evidence garnered in the appeal hearing that will state the issues before the Tribunal, the findings of fact in the specific case, and conclusions of law. The Hearing Officer is a neutral arbiter who ensures that the parties are afforded due process and the hearings are just and impartial. If any motions are submitted in the appeal, they will rule on the motions, issue subpoenas as appropriate, and schedule continuances or postponements if necessary. Who are the customers? Constituents of the Department of Workforce Solutions who are impacted by the administration of Unemployment Insurance laws and regulations and internal staff. Minimum Qualification Bachelor's Degree in Public Administration, Political Science, Business Administration, Social Services, or Labor Relations and four (4) years of experience in conducting administrative hearings, employment placement, claims adjudication, and/or investigations. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling eight (8) years may substitute for the required education and experience. Employment Requirements Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification within six (6) months of date of hire as a condition of continued employment. Working Conditions General office setting, exposure to Visual/Video Display terminal (VDT) and extensive personal computer and telephone usage with extended periods of sitting.
