PLAINTIFF PERSONAL INJURY LITIGATION ATTORNEY

Hybrid Expected Compensation:

$300,000-$450,000 with Uncapped Upside DeWitt Law Firm is seeking an experienced personal injury litigation attorney who wants quality cases, meaningful autonomy, strong support, and compensation tied directly to results. The attorney will have a caseload of approximately 40-80 litigation matters, with assignments adjusted based on complexity and workload. The docket primarily consists of automobile-negligence and premises-liability cases, along with select wrongful-death and catastrophic-injury matters. This is overwhelmingly a litigation position. There are no billable-hour requirements. Performance is evaluated based on case development, strategic judgment, responsiveness, client service, production, and results.

DeWitt Law Firm is an established and growing Florida law firm representing individuals and families injured by the negligence of others. We have built a strong presence throughout Florida and a reputation for combining aggressive advocacy with compassionate client service. Our attorneys benefit from a consistent case pipeline, support staff, modern legal technology, established marketing resources, and direct access to firm leadership. The attorney will be assigned appropriate support, typically including a paralegal and/or legal assistant. Although the attorney remains responsible for litigation strategy and overall case progression, this is not a position where the attorney is expected to handle every task alone. Our team works together to comprise litigation strategy and assist each other in handling the cases in a way that is most efficient and beneficial to the clients.

THE ROLE

The right candidate knows how to evaluate a case, identify its strengths and pressure points, develop an effective litigation plan, and keep the matter progressing. Attorneys have substantial autonomy over day-to-day strategy. Firm leadership remains available and expects to be consulted regarding major strategic decisions, settlement recommendations, and trial strategy.

Responsibilities include:

• Managing plaintiff-side personal injury cases from filing through settlement or trial.
• Developing and executing a clear strategy for each assigned matter.
• Drafting and arguing substantive pleadings, motions, and memoranda.
• Conducting and defending depositions of parties, witnesses, treating physicians, and experts.
• Handling hearings, mediations, case management conferences, and pretrial proceedings.
• Managing written discovery, discovery disputes, experts, and litigation deadlines.
• Evaluating liability, causation, damages, medical evidence, insurance coverage, and case value.
• Negotiating effectively with insurance carriers and defense counsel.
• Preparing clients, witnesses, evidence, and exhibits for depositions, mediation, and trial.
• Maintaining timely and professional communication with clients.
• Working collaboratively with assigned support staff, other attorneys, and firm leadership.
• Preparing cases for trial and trying them when trial is in the client's best interest.

QUALIFICATIONS

Required:

• Juris Doctor from an accredited law school.
• Active membership in good standing with The Florida Bar.
• Meaningful experience managing contested civil matters involving discovery, depositions, hearings, mediation, and motion practice.
• Knowledge of the Florida Rules of Civil Procedure and Florida state court practice.
• Strong legal writing, negotiation, organizational, and oral advocacy skills.
• Sound professional judgment and the ability to manage competing priorities and deadlines.
• A commitment to responsive client communication, teamwork, and accountability.

Preferred:

• Three or more years of personal injury litigation experience.
• Plaintiff-side personal injury experience.
• First-chair or second-chair jury-trial experience.
• Experience with automobile-negligence, premises-liability, wrongful-death, or catastrophic-injury matters.

We will also consider a strong insurance-defense attorney seeking to transition to plaintiff-side practice. Extensive first-chair trial experience is an advantage but is not an absolute requirement. Attorneys with strong deposition, motion, mediation, case-development, and trial-preparation experience are encouraged to apply.

COMPENSATION, SCHEDULE, AND BENEFITS

Compensation includes a stable draw together with performance-based compensation. A successful attorney in this position can realistically expect to earn approximately $300,000-$450,000 annually, with uncapped upside. Attorneys who successfully handle more advanced and higher-value cases may earn substantially more. The specific draw, transition period, and performance-compensation structure will be discussed transparently with qualified candidates during the interview process. This is a full-time hybrid position based in our Orlando office. Attorneys are generally expected to work from the office two to three days per week and may select their regular in-office days. Court appearances, depositions, mediations, trials, client meetings, and other case responsibilities may require additional in-person attendance. We do not impose billable-hour requirements. Attorneys have flexibility in managing their schedules but are expected to remain responsive, meet deadlines, prepare cases properly, and do what is reasonably necessary to advance their clients' interests.
