The Compliance Officer III will conduct investigations of allegations of misconduct by licensed physicians and acupuncturists; prepares supporting data for the issuance of investigative subpoenas; gathers evidence in preparation for statement of allegations, motions for summary suspensions and administrative and adjudicatory hearings; coordinates Board enforcement efforts with local, state and federal law enforcement and regulatory agencies; and performs related duties as required. Duties and Responsibilities (these are a general summary and not all inclusive): Reviews and investigates complaints and reports from individuals, hospitals, national data repositories, licensed health care providers, law enforcement agencies, medical insurance providers, governmental health care funding agencies and other sources to determine potential violations of laws, regulations or standards of medical care affecting the public health, safety and/or welfare of the citizens of the Commonwealth. Confers with agency staff concerning laws, rules, regulations and standards of medical practice governing assigned activities, progress of cases, resource requirements and coordination with other agencies. Works with clinical care investigators, complaint counsel and other Board staff in investigation, preparation, presentation and litigation of cases. Provides investigative assistance on an emergency basis based on a physician's immediate threat to the public. Reviews Board complaint files, databases and licensing information to identify and locate physicians alleged to have committed violations of law, regulation or medical standards of practice. Analyzes medical records, financial records, court records, law enforcement reports, and relevant specialized and/or technical documents, both paper and electronic, to determine the extent and nature of any violation of law, regulation or standard of medical practice by a Massachusetts physician. Locates witnesses, complainants, and potential witnesses, and schedules interviews. Interviews patients and witnesses, as well as physicians under investigation, to determine the potential testimonial evidence from such sources. Drafts clear, concise, accurate and relevant documents, correspondence, reports and other material as required, and testifies as needed. Provides support, maintains contact, and communicates case status to all patients/complainants/witnesses. Responds to inquiries in order to provide information concerning agency policies, procedures, and laws, rules and regulations governing agency activities. Confers with parties to complaints in order to resolve issues and encourages compliance with established laws, rules, and regulations. Makes recommendations concerning changes in policies and procedures governing assigned unit activities and confers with management staff and other agency personnel to provide information, resolve problems and/or recommend changes in policies and procedures. Provides training in Board procedures and attends relevant training as required. Provides on-the-job training for employees. Keeps abreast of all relevant developments and participates in Board outreach activities. Conducts self in a professional manner in adherence with Massachusetts law, Board regulations, policies, procedures and protocols. Consistently represents the Board in a professional, competent, and ethical manner. Efficiently and effectively manages caseload, prioritizing work appropriately, setting and achieving goals and responding to deadlines in a timely manner. Cooperates and/or coordinates with local, state and federal law enforcement agencies in the joint investigation and prosecution of violations of laws, regulations or standards of medical practice which threaten the public health, safety and/or welfare. Adheres to strict legal and regulatory requirements of confidentiality and prohibitions against unauthorized disclosure of sensitive, confidential and privileged information regarding patients, physicians and law enforcement investigations. Maintains productive working relationships with Board staff and is responsive to supervision. Performs other related duties as required.

Preferred Qualifications:
Knowledge of the laws, rules, regulations, policies and procedures governing assigned agency activities. Knowledge of the principles and practices of administrative adjudicatory proceedings, and the practices of the Board and its committees. Minimum Entrance Requirements:
Applicants must have at least (A) four years of full-time, or equivalent part-time, experience in investigatory or law enforcement work, or regulatory administration work (B) and equivalent combination of the required experience and the substitutions below.
Substitutions:
A Bachelor's or higher degree may be substituted for a maximum of the two years of the required experience.
- Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.
Salary placement is determined by a combination of factors, including the candidate's years of directly related experience and education, and alignment with our internal compensation structure as set forth by the Human Resources Division's Hiring Guidelines. For all bargaining unit positions (non-management), compensation is subject to the salary provisions outlined in the applicable collective bargaining agreement and will apply to placement within the appropriate salary range.
