Galveston County Workers will report to the Employer's Bacliff, Texas reporting location and travel to Galveston Bay each workday to perform the oyster harvesting duties described below. The Employer will provide, at no cost to the worker, daily transportation from the reporting location at 4728 10th St., Bacliff, Texas, to the applicable harvesting/departure location in the Galveston Bay area and return transportation to the reporting location at the end of the workday.
JOB DUTIES
Harvest, gather, and handle oysters from oyster beds, leases, reefs, cages, baskets, bags, or other oyster harvesting areas using hands, tongs, rakes, baskets, cages, nets, or other basic shellfish harvesting equipment. Remove oysters from cages, bags, baskets, or harvesting equipment and place them into baskets, sacks, tubs, bins, coolers, or containers. Sort, count, measure, and inspect oysters as instructed to separate legal-size, marketable, undersized, broken, dead, or damaged oysters. Load and unload oysters, baskets, sacks, cages, coolers, tools, and supplies by hand from docks, boats, trucks, storage areas, or harvesting areas. Place, retrieve, move, clean, and assist with basic maintenance of oyster cages, bags, baskets, lines, floats, markers, weights, and related harvesting equipment. Rinse, wash, clean, and remove mud, debris, shells, and fouling from oysters, cages, baskets, containers, tools, boats, docks, and work areas. Pack, stack, store, and move harvested oysters using ice or other approved storage methods as instructed. Assist with preparing harvesting equipment before use and cleaning equipment after use. Work is performed outdoors and may involve wet, muddy, cold, hot, or variable weather conditions. The position requires standing, walking, bending, lifting, carrying, and working with basic hand tools. No education, experience, license, or certification required. Employer will provide on-the-job training.

Must be able to follow verbal instructions and perform repetitive manual labor outdoors in wet, muddy, hot, cold, or variable weather conditions. Must be able to stand, walk, bend, stoop, reach, lift, carry, push, and pull oysters, baskets, sacks, cages, coolers, tools, and supplies during the workday. Must be able to lift and carry up to 50 pounds. Must be able to swim or remain safe in and around water due to work performed near boats, docks, oyster beds, and wet or slippery surfaces. Must be able to work safely around boats, docks, oyster beds, cages, baskets, hand tools, and wet or slippery surfaces. Must be able to sort, count, measure, rinse, clean, pack, load, and unload oysters as instructed. Must be able to distinguish marketable oysters from undersized, broken, dead, damaged, or debris-covered oysters after training. Must be reliable, report to work on time, follow workplace safety and sanitation rules, work as part of a crew, and follow supervisor instructions. No supervisory duties, vessel operation, commercial driving, mechanical repair, seafood processing, shucking, sales, or management duties required.
WAGE AND WORK SCHEDULE
Basic Wage Rate:
$19.19 per hour. The Employer will pay at least the applicable required wage for all hours worked.
Overtime:
Overtime is not available.
Hours:
Approximately 40 hours per week.
Schedule:
Monday through Saturday, approximately 40 hours per week between 5:00 AM and 1:00 PM. Specific workdays and daily hours may vary based on weather, tides, legally permitted harvesting hours, and harvest-area status.
Workweek:
Wages will be calculated based on a single workweek.
Frequency of Pay:
Employees will be paid weekly.
DEDUCTIONS
The Employer will make all payroll deductions required by law, including applicable federal taxes and FICA. The Employer does not intend to make deductions from workers' wages other than those required by law. No deduction will reduce a worker's pay below the wage required under applicable law.
TOOLS, SUPPLIES, AND EQUIPMENT
The Employer will provide, without charge or deposit, all tools, supplies, and equipment required to perform the assigned job duties.
DAILY WORK TRANSPORTATION
The Employer will provide, at no cost to the worker, daily transportation from the reporting location at 4728 10th St., Bacliff, Texas, to the applicable harvesting/departure location in the Galveston Bay area and return transportation to the reporting location at the end of the workday.
INBOUND TRANSPORTATION AND SUBSISTENCE
If the worker completes at least 50 percent of the period of employment covered by this Job Order, the Employer will provide, pay in advance, or reimburse the worker for the reasonable costs of transportation and daily subsistence from the place from which the worker came to work for the Employer, whether in the United States or abroad, to the place of employment, as required by applicable H-2B regulations. Transportation will be provided or reimbursed based on the most economical and reasonable common-carrier transportation for the distances involved. The Employer will pay all required qualifying travel costs for H-2B workers, including meals and lodging when necessary. Meals and daily subsistence during qualifying travel will be provided or reimbursed at a minimum of $16.78 per day without receipts, or up to a maximum of $68.00 per day with receipts documenting the worker's actual expenses. Reasonable lodging expenses incurred during required overnight travel will be provided or reimbursed when required by applicable H-2B regulations.
RETURN TRANSPORTATION AND SUBSISTENCE
If the worker completes the period of employment covered by the Job Order, or if the worker is dismissed from employment by the Employer for any reason before the end of the certified period, the Employer will provide or pay for the worker's reasonable costs of return transportation and daily subsistence from the place of employment to the place from which the worker, disregarding intervening employment, departed to work for the Employer, as required by applicable H-2B regulations. Transportation will be provided or reimbursed based on the most economical and reasonable common-carrier transportation for the distances involved. Meals and daily subsistence during qualifying return travel will be provided or reimbursed at a minimum of $16.78 per day without receipts, or up to a maximum of $68.00 per day with receipts documenting the worker's actual expenses. Reasonable lodging expenses incurred during required overnight return travel will be provided or reimbursed when required by applicable H-2B regulations.
VISA AND BORDER-CROSSING FEES
The Employer will reimburse H-2B workers during the first workweek for all visa, visa-processing, border-crossing, and other related fees, including those mandated by the government, incurred by the H-2B worker, as required by law. Passport expenses and other expenses primarily for the worker's benefit are excluded where permitted by law.
RECRUITMENT FEES
The Employer, its agents, attorneys, employees, and recruiters will not seek or receive payment of any kind from any worker for any activity related to obtaining H-2B employment or labor certification, including recruitment fees.
THREE-FOURTHS GUARANTEE
The Employer guarantees to offer each worker employment for a total number of work hours equal to at least three-fourths (3/4) of the workdays in each applicable 12-week period during the period covered by this Job Order, in accordance with applicable Department of Labor H-2B requirements.
HOUSING, BOARD, AND LODGING
The Employer does not provide or guarantee housing, board, or lodging as part of this job opportunity. Workers are responsible for their ordinary housing expenses at the place of employment. This provision does not affect the Employer's obligation to provide or reimburse lodging when required in connection with qualifying inbound or return travel under the H-2B regulations.
