Job Description

McElroy Law, located in Southpointe (Cannonsburg, PA), is seeking applicants for an Associate Attorney to join our growing team. This is a full-time, hybrid position that requires in-office work at least three days each week. We are a family-owned firm that provides compassionate legal representation in employment, oil and gas, real estate, and business matters. Our practice area serves clients throughout the Ohio Valley including PA, WV, and OH. Job Summary The Associate will assist with representation of both businesses and employees in matters arising under federal, state, and local laws. Responsibilities include negotiating, mediating, and litigating disputes, as well as advising employers on compliance and legal risk management. The Associate will draft employment-related and business-related legal documents. This position requires an active Pennsylvania law license in good standing, adherence to all ethical obligations, ongoing awareness of legal and regulatory developments, and accurate timekeeping for billing purposes. Duties Meet with potential clients to discover their legal needs and determine if they are a right fit for the firm. Manage a caseload of employment law plaintiff cases including allegations of discrimination, harassment, and retaliation under Title VII, the ADA, ADEA, FLSA, FMLA, and EPA, and various state and local statutes. Conduct discovery and perform legal research; Prepare, draft, and review legal documents including pleadings, motions, complaints, and agreements. Advise employers on compliance with federal, state, and local employment laws and regulations such as Title VII, ADA, ADEA, FLSA, FMLA, and EPA, and various state and local statutes. Advise employers on handling employee relations issues, disciplinary actions, terminations, and layoffs in compliance with applicable laws and regulations. Draft Contracts and Agreements, Workplace Policies and Handbooks, and other business related documents. Provide training to employers and employees on preventing harassment, discrimination, and retaliation in the workplace. Negotiate executive compensation packages and employment agreements for key executives, senior management and professionals. Conduct audits of employer practices and policies to identify areas of legal risk or non-compliance and provide recommendations for remediation. Represent businesses or employees in negotiations, mediation, or litigation of employment and business disputes. Communicate with clients regarding the status of their case, proactively providing updates, and reviewing discovery and all other essential court documentation. Cultivate and maintain strong client relationships by ensuring exceptional legal services and effective communication. Track and enter time per firm policy. Attend CLE as required to maintain PA and other state Bar license in good standing and to stay abreast of changes in employment law. Participate in business development. Perform other tasks as assigned. Minimum Qualifications Juris Doctorate Degree from accredited law school. At least one year of experience in employment and business law. At least one year of litigation experience. Strong skills in research, writing, courtroom presentation, and common technology as they relate to the practice of law. Experience in energy law, including oil and gas, is a plus. Licensed to practice law in good standing in the state of Pennsylvania. Additionally licensed in WV and Ohio is a plus.
