Job Summary The position serves as the Direct Care and Treatment (DCT) Division Director of Contracts and Legal Compliance, responsible for executive management of DCT contracting in accordance with state and federal laws and regulations. In this position, you will provide oversight of agency-wide contract development and management functions, legal review, ethics, and legal advice on contracts including resolution of legal issues related to contracts.Responsibilities include:
Direct the DCT Contracts unit and perform all personnel management, including staffing, performance management and training. Oversee and direct provision of legal advice and guidance. Present options, and provide recommendations to executives on complex and novel legal questions as they arise, related to enterprise risk management, Tort Claims Act, real property, indemnification, contracts law, Minnesota State Constitution, Arbitration, chapters 16A and 16C, Minnesota Government Data Practices Act, grantmaking, Trade Secrets, Intellectual Property, insurance law, data sharing and business associate agreements, payer/provider law and related CMS regulations, ethics and conflicts of interest. Participate in contracts-related and Agency-wide continuous improvement efforts. Leading Self Leading Others Leading the Organization Leading Outside the Organization Getting Work Done Qualifications Minimum Qualifications To be qualified for and considered for this position, applicants must meet all the minimum qualifications listed below. To ensure proper crediting, please ensure your resume contains descriptions of your work experience sufficient for comparison against the requirements stated below and indicate the beginning and ending month and year for each job held. Juris Doctorate (J.D.) from an ABA accredited law school; AND Current license and in good standing to practice law in Minnesota; AND Five (5) years of experience as a practicing attorney providing legal advice and guidance in contract law.Experience must demonstrate:
Experience drafting, reviewing, negotiating, and interpreting agreements. Experience developing contract templates, policies, or legal guidance. Experience advising stakeholders and leadership on legal risks, ethical conduct, contract interpretation, and compliance with applicable federal and state laws and regulations while operating within ambiguous situations. Experience planning and delivering complex legal training to non-legal audiences and serving as a trusted resource to external partners. Experience engaging actively and proactively with diverse communities and perspectives. At least one (1) year of experience in a supervisory or leadership capacity, which may include managing legal staff, leading legal initiatives, or mentoring attorneys or other professionals. Preferred Qualifications Experience supporting hospitals, health systems, managed care organizations, government healthcare programs or healthcare technology organizations. Experience in drafting, negotiating, and providing line staff and Senior Executives advice related to Requests for Proposals and Contracts under Minnesota state law. Experience working with or detailed knowledge of the Minnesota Government Data Practices Act (MGDPA) and the Health Insurance Portability and Accountability Act (HIPAA). Experience advising on Minn. Stat. §43A.38, Code of Ethics for Employees in the Executive Branch, and related policies. Experience working with state government contracts, including knowledge and experience with Minn. Stat. sec. 16A, 16B, and 16C. Experience reviewing and negotiating payer/provider agreements. Our employees are dedicated to ensuring cultural responsiveness.
