Description:
Krause Estate Planning & Elder Law Center is seeking an experienced attorney to join our growing team, with a primary focus on probate and estate administration and a secondary focus on estate planning. This is an excellent opportunity for an attorney who enjoys taking ownership of their cases, working directly with clients, and guiding matters from initial engagement through resolution. The ideal candidate is confident managing a caseload, comfortable appearing in court, and able to provide leadership and direction to the paralegals and legal assistants supporting their matters. The position is expected to be approximately 80% probate and estate administration and 20% estate planning, although the mix may fluctuate based on client and firm needs.
What You'll Do:
Probate & Estate Administration- Independently manage probate and estate administration matters from initial engagement through closing. Counsel personal representatives, trustees, beneficiaries, and families regarding the probate process, fiduciary responsibilities, estate assets, creditor claims, distributions, deadlines, and related matters. Develop case strategy, identify potential risks or disputes, and provide clients with practical legal guidance. Prepare and review petitions, inventories, accountings, notices, affidavits, closing documents, and other probate-related pleadings and filings. Appear virtually and in courts throughout Wisconsin for probate hearings and related proceedings. Handle contested probate matters when necessary, including discovery, motions, briefing, negotiations, settlement discussions, and other litigation-related work. Communicate directly with clients, courts, opposing counsel, fiduciaries, financial professionals, and other parties involved in estate administration. Monitor deadlines and case progression to ensure matters move efficiently toward completion. Provide legal direction and oversight to paralegals and legal assistants, including delegation, review, coaching, and quality control. Estate Planning- Manage a smaller caseload of straightforward to moderately complex estate planning matters. Counsel clients regarding wills, trusts, powers of attorney, healthcare directives, beneficiary designations, asset ownership, and related planning considerations. Draft and review estate planning documents based on clients' goals, family circumstances, and assets. Identify matters requiring more advanced planning and collaborate with other attorneys or professionals when appropriate. What's Required? Juris Doctor (J.D.) degree Active Wisconsin law license in good standing Experience independently managing legal matters and client relationships Strong written and verbal communication skills Ability to manage multiple cases, priorities, and deadlines while exercising sound professional judgment What's Highly Preferred? Experience with probate, estate administration, estate planning, elder law, trust administration, or a related practice area Litigation experience, particularly involving discovery, motions, briefs, negotiations, or contested court matters Experience appearing before Wisconsin courts Experience supervising, delegating to, or working closely with paralegals and legal assistants Above all, we're looking for an attorney who takes ownership of their work, communicates well with clients and colleagues, and wants to be part of a collaborative, team-oriented practice.
