Interested applicants should report to any State Workforce Agency (SWA) career center for help in contacting the employer. Referral by a career center provides program guarantees and protections that may not be available to a worker not referred. Workers must have valid identification for I-9 preparation when they report to the employer location to begin work. The employer may use the U.S. Citizenship and Immigration Services E-Verify Program to verify employment eligibility. C. Workers referred to this job by a SWA should report to a career center between 5 and 9 work days before the job start date to verify the job start date is the same. Failure to do so may disqualify the worker from the assurances of this Job Order. Worksites are located in Houston county in Alabama. The housing is in Marianna, Florida. D.

Watermelon harvesting:

by hand, the worker will walk down the watermelon field rows where the watermelon will be harvested. The worker will first cut the vine off the watermelon with a small knife and turn the watermelon over. The worker will bend
over harvesting the ripe watermelon which can vary in weight from 20lbs to 60lbs from the ground and tossing the watermelon to the worker next to him and this worker will toss the watermelon to the next worker and so on, until the watermelon is then
tossed to the person inside the bus who will place the watermelon on the floor.

Watermelon Packing:

When the bus is full, it will be taken to the packing house where the workers will unload the watermelon and put it in a conveyer belt that will transport the watermelon into the packing house where it will be separated by size,
labeled and packed.

Note:

The Packing house is located inside the Farm and at least 50% of the product processed belongs to the Fixed Site Employer.
Harvesting beans by hand, the worker will walk down the field rows where the beans will be harvested. The worker will stoop/lean over the plant inspecting the quality of the beans. Worker will carefully young and tender 3 inch bean pods by holding the
stem with one hand and pulling pods with the other, without damaging it or the plant and putting them in a container. Once the container is full the worker will take the container to the truck and dump the content. The worker will go back to his picking
area and fill his container up again, repeating the process through the work day.

General Maintenance:

Workers on physical work restrictions or when harvesting work is not available may be required to perform miscellaneous clean-up work on work site property, on structures utilized in the work site operation, and on housing for
harvesting workers. Such clean-up activities include the sprouting, pruning, and painting of trees; debris, mowing, weed, and vine removal; irrigation repair; housing and structure cleaning and repair.
The worker in order to perform this kind of work must be able to work outside for at least 6 hours a day in all kinds of weather and be in a possession of the requisite physical strength and endurance, working quickly and skillfully with their hands
repeatedly. The employer will provide the tools necessary (if applicable) to perform the described job duties without charge to the worker. Employer may deduct the reasonable cost of damages and/or replacement of tools and/or equipment if such repair
or replacement results from willful neglect or gross negligence after the damage has occurred and after gaining the employee’s written authorization to make the deduction. Pay – Adverse Effect Wage Rate (AEWR): $16.08 per hour guarantee. ¾ Guarantee is in effect.

Withholding:

Federal Income Tax, Social Security and Medicare, and any deductions agreed to by the worker in writing. Work rules will be found in the Clearance Order. E. Contract period is June 1, 2025 to August 1, 2025.

Hours:

36 hours per week

Days/Hours:

Monday thru Saturday 6 hours per day. Work may be offered but not required on Sundays and holidays. Extra work hours may be offered based on weather and other conditions. F. Employer will refund workers living outside commuting distance the reasonable transportation and subsistence costs to report for the first day of work on the 50% date. Will provide workers who complete the contract period the reasonable cost of transportation and subsistence to return to place of recruitment or to report to the next H-2A job. G.

Housing and Board:

See ETA 790. Meals (Board): See ETA 790. Housing meets the requirements of Federal, State and Local regulations. Rules regarding living accommodations will be found in the Clearance Order. Transportation provided by the employer meets the requirements of Federal, State and Local regulations. H. Prohibition against preferential treatment of aliens: The employer’s job offer must offer to U.S. workers no less than the same benefits, wages, and working conditions that the employer is offering, intends to offer, or will provide to H-2A workers. Job offers may not impose on U.S. workers any restrictions or obligations that will not be imposed on the employer’s H-2A workers. This does not relieve the employer from providing to H-2A workers at least the same level of minimum benefits, wages, and working conditions which must be offered to U.S. workers. I.
