This is an Agricultural Labor Program clearance order for temporary or seasonal agricultural workers.

Interested applicants should report to any State Workforce Agency (SWA) career center for help in contacting the employer. Referral by a career center provides program guarantees and protections that may not be available to a worker not referred. Workers must have valid identification for I-9 preparation when they report to the employer location to begin work. The employer may use the U.S. Citizenship and Immigration Services E-Verify Program to verify employment eligibility. C. Workers referred to this job by a SWA should report to a career center between 5 and 9 work days before the job start date to verify the job start date is the same. Failure to do so may disqualify the worker from the assurances of this Job Order. Worksites are located in Gadsden and Jackson counties. Housing is located in Quincy, Florida (Gadsden County) D.

Job Offer:

Workers will perform assign duties as instructed by their supervisor, Harvesting of vegetables: Once at the picking location, doing a row at a time, workers will move down the rows plucking the vegetables from the plants and putting them in a container. Once the container is full the worker will take the container to the truck and dump the content. The worker will go back to his picking area and fill his container up again, repeating the process through the work day.

Vegetable Packing:

Trucks will take the harvested vegetables to the packing house which is located inside the farm, workers will pick out the vegetables that will be used for seed the rest of the vegetables will be separated by size, labeled and packed.

Field Maintenance:

workers will lay and take out plastic, tie, stake and prune plants, clean micro jets and remove plastic drip lines, raking, cleaning areas around the farm and buildings in the farm, using hands or a hoe worker will remove dead plants and weeds. Workers who qualify may occasionally help with moving trucks and using forklifts.

Note:

The packing house is located inside the Farm and more than 50% of the product processed is produced by the Fixed Site Employer. The worker in order to perform this kind of work must be able to work outside for at least 6 hours a day in all kinds of weather and be in a possession of the requisite physical strength and endurance, working quickly and skillfully with their hands repeatedly. The employer will provide the tools necessary (if applicable) to perform the described job duties without charge to the worker. Employer may deduct the reasonable cost of damages and/or replacement of tools and/or equipment if such repair or replacement results from willful neglect or gross negligence after the damage has occurred and after gaining the employee’s written authorization to make the deduction. Employees may volunteer to work additional hours when work is available, there is a possibility that available work hours will be in excess of 20% of the hours offered but they are not guaranteed, the worker is not required to work more than the stated daily hours in the contract and/or on a worker’s Sabbath or federal holidays Workers should expect occasional periods of little or no work because of weather, crop or other conditions beyond the employer’s control. These periods can occurany time throughout the season. If workers request a leave of absence during the contract period, if the worker has been offered an opportunity to work, the hours will be deducted from the hours offered under the ETA-790 for the purposes of the three-quarter
guarantee. A copy of the work contract or a copy of the ETA 790 in lieu of a work contract, and any modifications, will be provided to the H-2A worker no later than the time at which the worker applies for the Visa, or to a worker in corresponding employment, no later than on the day work commences. For an H-2A worker going from an H-2A employer to a subsequent H-2A employer, a copy of the contract will be provided no later than the time an offer of employment is made by the subsequent H-2A employer

Pay:

Florida Adverse Effect Wage Rate (AEWR) – $16.23 per hour ¾ Guarantee is in effect.

None Pay is: Weekly Employer provides tools/equipment.

Withholding:

Federal Income Tax, Social Security and Medicare, and any deductions agreed to by the worker in writing. Work rules will be found in the Clearance Order. E. Contract period is May 26, 2025 to July 15, 2025.

Hours:

36 hours per week

Days/Hours:

Monday thru Saturday 6 hours per day. Work may be offered but not required on Sundays and holidays. Extra work hours may be offered based on weather and other conditions. F. Employer will refund workers living outside commuting distance the reasonable transportation and subsistence costs to report for the first day of work on the 50% date. Will provide workers who complete the contract period the reasonable cost of transportation and subsistence to return to place of recruitment or to report to the next H-2A job. G. Housing and Board.

Housing:

Will provide free housing for workers who arrive from outside daily commuting distance. Family housing is not available. Meals (Board): Employer will provide a free and convenient kitchen and transport workers to a grocery store at least once per week. Workers will purchase and prepare their own meals. Housing meets the requirements of Federal, State and Local regulations. Rules regarding living accommodations will be found in the Clearance Order. Transportation provided by the employer meets the requirements of Federal, State and Local regulations. H. Prohibition against preferential treatment of aliens: The employer’s job offer must offer to U.S. workers no less than the same benefits, wages, and working conditions that the employer is offering, intends to offer, or will provide to H-2A workers. Job offers may not impose on U.S. workers any restrictions or obligations that will not be imposed on the employer’s H-2A workers. This does not relieve the employer from providing to H-2A workers at least the same level of minimum benefits, wages, and working conditions which must be offered to U.S. workers. I.
