Interested applicants should report to any State Workforce Agency (SWA) career center for help in contacting the employer. Referral by a career center provides program guarantees and protections that may not be available to a worker not referred. Workers must have valid identification for I-9 preparation when they report to the employer location to begin work. The employer may use the U.S. Citizenship and Immigration Services E-Verify Program to verify employment eligibility. C. Workers referred to this job by a SWA should report to a career center between 5 and 9 work days before the job start date to verify the job start date is the same. Failure to do so may disqualify the worker from the assurances of this Job Order. Worksites are located in Gilchrist County Housing is located in Micanopy, Florida (Alachua County) D.

Job Offer:

Harvesting Watermelon by hand, the worker will walk down the watermelon field rows where the watermelon will be harvested. The worker will first cut the vine off the watermelon with a small knife and turn the watermelon over. The worker will bend over harvesting the ripe watermelon which can vary in weight from 20 to 60 lbs. from the ground and tossing the watermelon to the worker next to him and this worker will toss the watermelon to the next worker and so on, until the watermelon is then tossed to the person inside the bus who will place the watermelon on the floor.

Packing:

When the bus is full, it will be taken to the packing house where the workers will unload the watermelon and put it in a conveyor belt that will transport the watermelon into the packing house where it will be separated by size, labeled and packed.

Note:

The packing house is located inside the Farm and more than 50% of the product processed is produced by the Fixed Site Employer.

General Maintenance:

Workers on physical work restrictions or when harvesting work is not available may be required to perform miscellaneous clean-up work on work site property, on structures utilized in the work site operation, and on housing for harvesting workers. Such clean-up activities include the sprouting, pruning, and painting of trees; debris, weed, and vine removal; irrigation repair; housing and structure cleaning and repair. The worker in order to perform this kind of work must be able to work outside for at least 6 hours a day in all kinds of weather and be in possession of the requisite physical strength and endurance to repeat the picking process rapidly, the employer will
provide the tools necessary to perform the described job duties without charge to the worker. The employer will charge the worker for reasonable costs related to the worker’s refusal or negligent failure to return the tools or due to such worker’s willful damage or destruction of the tools. Employees may volunteer to work additional hours when work is available, there is a possibility that available work hours will be in excess of 20% of the hours offered but they are not guaranteed, the worker is not required to work more than the stated daily hours in the contract and/or on a worker’s Sabbath or federal holidays Workers should expect occasional periods of little or no work because of weather, crop or other conditions beyond the employer’s control. These periods can occur any time throughout the season. If workers request a leave of absence during the contract period, if the worker has been offered an opportunity to work, the hours will be deducted from the hours offered under the ETA-790 for the purposes of the three-quarter guarantee. A copy of the work contract or a copy of the ETA 790 in lieu of a work contract, and any modifications, will be provided to the H-2A worker no later than the time at which the worker applies for the Visa, or to a worker in corresponding employment, no later than on the day work commences. For an H-2A worker going from an H-2A employer to a subsequent H-2A employer, a copy of the contract will be provided no later than the time an offer of employment is made by the subsequent H-2A employer.

Pay:

Florida Adverse Effect Wage Rate (AEWR) – $16.23 per hour ¾ Guarantee is in effect.

Withholding:

Federal Income Tax, Social Security and Medicare, and any deductions agreed to by the worker in writing. Work rules will be found in the Clearance Order. E. Contract period is May 15, 2025 to June 15, 2025.

Hours:

36 hours per week

Days/Hours:

Monday thru Saturday 6 hours per day. Work may be offered but not required on Sundays and holidays. Extra work hours may be offered based on weather and other conditions. F. Employer will refund workers living outside commuting distance the reasonable transportation and subsistence costs to report for the first day of work on the 50% date. Will provide workers who complete the contract period the reasonable cost of transportation and subsistence to return to place of recruitment or to report to the next H-2A job. G. Housing and Board.

Housing:

Will provide free housing for workers who arrive from outside daily commuting distance. Family housing is not available. Meals (Board): Employer will provide three meals per day at a cost to the worker of $15.88 per day. Employer will provide transportation ones per week to go to the stores and do laundry. Housing meets the requirements of Federal, State and Local regulations. Rules regarding living accommodations will be found in the Clearance Order. Transportation provided by the employer meets the requirements of Federal, State and Local regulations. H. Prohibition against preferential treatment of aliens: The employer’s job offer must offer to U.S. workers no less than the same benefits, wages, and working conditions that the employer is offering, intends to offer, or will provide to H-2A workers. Job offers may not impose on U.S. workers any restrictions or obligations that will not be imposed on the employer’s H-2A workers. This does not relieve the employer from providing to H-2A workers at least the same level of minimum benefits, wages, and working conditions which must be offered to U.S. workers. I.
