Interested applicants should report to any State Workforce Agency (SWA) career center for help in contacting the employer. Referral by a career center provides program guarantees and protections that may not be available to a worker not referred. Workers must have valid identification for I-9 preparation when they report to the employer location to begin work. The employer may use the U.S. Citizenship and Immigration Services E-Verify Program to verify employment eligibility. C. Workers referred to this job by a SWA should report to a career center between 5 and 9 work days before the job start date to verify the job start date is the same. Failure to do so may disqualify the worker from the assurances of this Job Order.

Job Offer:

23 Farmworkers. Workers will perform assign duties as instructed by their supervisor, Cabbage harvesting: The cabbage Cutters will line up in designated cabbage rows. Workers will bend over each cabbage to cut. After cutting the cabbage, workers will inspect and trim. Workers will then put the cabbage in a bag and put the bag on a stainless steel table that will be continually pushed behind the cutters as they proceed on their rows. Workers should be able to keep up with the machine.

Harvesting tomatoes:

Using a bucket, workers will hand pick and harvest mature tomatoes from the plant by twisting the fruit from the vine (also remove calyz and stem from tomato) and place fruit into the bucket. Harvesting process will be repeated until the tomato bucket is full. The harvester will lift the bucket and place on shoulder and stand upright. The harvester will walk the filled bucket at a brisk pace to the field truck and toss filled buckets (by lifting bucket from their shoulder with both hands) to the harvest dumper and repeat process.

Harvesting of Squash:

Once at the picking location, doing a row at a time, workers will move down the rows plucking the vegetables from the plants and putting them in a container. Once the container is full the worker will take the container to the truck and dump the content. The worker will go back to his picking area and fill his container up again, repeating the process through the work day.

Vegetable Packing:

Trucks will take the harvested vegetables to the packing house which is located inside the farm, workers will pick out the vegetables that will be used for seed the rest of the vegetables will be separated by size, labeled and packed. Field packing activities will also take place in the field.

Pay – Adverse Effect Wage Rate (AEWR): $16.08 per hour guarantee. ¾ Guarantee is in effect.

Withholding:

Hours:

36 hours per week

Days/Hours:

Monday through Saturday 6 hours per day. Work may be offered but not required on Sundays and holidays. Extra work hours may be offered based on weather and other conditions. F. Employer will refund workers living outside commuting distance the reasonable transportation and subsistence costs to report for the first day of work on the 50% date. Will provide workers who complete the contract period the reasonable cost of transportation and subsistence to return to place of recruitment or to report to the next H-2A job. G.

See ETA 790. Meals (Board): See ETA 790. Housing meets the requirements of Federal, State and Local regulations. Rules regarding living accommodations will be found in the Clearance Order. Transportation provided by the employer meets the requirements of Federal, State and Local regulations. H. Prohibition against preferential treatment of aliens: The employer’s job offer must offer to U.S. workers no less than the same benefits, wages, and working conditions that the employer is offering, intends to offer, or will provide to H-2A workers. Job offers may not impose on U.S. workers any restrictions or obligations that will not be imposed on the employer’s H-2A workers.
