Contract Manager Lake Mary, FL System One is seeking a ContractManager on a permanent basis with our client. This is a greatopportunity to join an industry leader in power generation andenergy storage solutions! The Contract Manager is responsible forcontract management of their assigned projects within the NewGeneration Systems (NGS) Business Unit Project Execution teamsengaged in the execution of contracts for the design, delivery,start-up, turnover, and initial warranty of contracted projects.

The primary focus of the Contract Manager is working closely witheach Project Manager to fully understand the commercial obligationsand potential liabilities accepted by the business in executingeach contract. The Contract Manager and Project Manager worktogether to develop and maintain a Risk Register for each projectto assess initial and emerging risks. The Contract Manager isresponsible for ensuring each Project Team implements standardizedcorrespondence and milestone management tools and procedures tominimize/avoid financial penalties while optimizing financialopportunities throughout each contract’s life cycle. The ContractManager is a key member of each project’s Claim Management teamthat includes project management, construction & commissioningmanagement, EPC management, supply chain management, correspondencemanagement, and schedule management (both MPW schedule efforts forplanning and execution of MPW’s scope of supply, and the EPC’sschedule planning and execution for their scope of supply and scopeof work).

ESSENTIAL DUTIES & RESPONSIBILITIES

Coordinate andconduct Initial Contract Reviews following contract turnover fromCommercial Operations to the Project Execution Team with criticalmembers of each Contract Execution Team.

Project Director | Project Manager | Deputy ProjectManager, Project Engineering Manager, Project Supply Chain Manager,Project Scheduler, Construction & Commissioning ServicesRepresentative, Project Scheduler, EPC Schedule Analyst, ProjectFinancial Analyst, and Contract Manager. Ensure the project teamclearly understands the Contract Requirements and Responsibilities,such as , scope of supply, scope of work accepted, key milestonesand dates, guarantees, potential liabilities, reportingrequirements, incoming & outgoing invoicing requirements, incomingand outgoing payment approval requirements, goods deliverycoordination requirements, damaged goods and/or non-compliant goodsnotification requirements, risk of loss transfer provisions, titletransfer provisions, Country of origin or other supplierrestrictions, obligations and DOR associated with taxes, tariffs,and duties, dispute notification and resolution processes asestablished by each contract commercially executed. Establishinitial and recurring project Risk Reviews with key project leadersto routinely update the project Risk Register monthly, and othertimes as required in the event of emergent risks. Documentpotential contract liabilities accepted in each contract executed;to include, but not limited to all liquidated damages for delay indeliveries, delay in project completion, shortfalls in performanceguarantees, and overall contract liabilities in the event offailure to perform. Develop the tools needed to evaluate potentialfinancial impacts for each potential liability. Document any “MustMake” guarantees stated or implied in each contract. Providevisibility into project execution progress approaching, real-time,and retirement of potential liabilities established by eachcontract. Work directly with the PD | PM(s) | DPM(s) and ScheduleAnalyst to establish and update quarterly a Level 1 Schedule toinclude critical contract milestones for the awareness of theProject Execution Team and

executive management to assessPlan | Forecast | Actual performance against Contract Baseline 0requirements. Update the plan whenever contract agreements areofficially changed or amended to reflect changes in the Baselinefor each project. Actively support the development, review, andmanagement of all correspondence associated with actual and/orpotential claims against our client associated with each projectContract or project Purchase Order working in close cooperationwith the PD | PM(s) | DPM(s), Director of Contracts Risks andClaims, In-House Counsel, Construction & CommissiongRepresentative(s), EPC and MPW Schedule Analysts (as required), andSCMs (as required). Support both PD | PM(s) | DPM(s) and SCMs indeveloping and executing financial recovery strategies for ProjectImpacts incurred because of actions / inactions taken byorganizations and activities outside of NGS. Support the projectexecution team in developing and maintaining project specificcorrespondence and work history tracking tools to establish anongoing history of the project to enable rapid and effectivedefense of claims that can arise between project initiation andproject completion. Look for and implement improvementopportunities associated with future contract commercial standardsor contract templates, project Kick-Off templates, projectreporting templates, and project reviews. Coordinate with the PD |PM(s) | DPM(s) and their Financial Analyst to ensure company policyis adhered to regarding the reservation of risk funds, reduction inrevenue receipts, and communication of potential financialliabilities associated with potential risks and claims as itrelates to both financial management and reporting of NGScontracts.

Experience:

Bachelor’s degree (BS) in Engineering, or a relatedfield, and/or a Law degree or from four-year college or university;and 6 (six) years related experience.

Language Skills:

Ability to write reports, business correspondence, andprocedure manuals. Ability to effectively present information andrespond to questions from groups of managers, clients, customers,and the public.

Mathematical Skills:

Ability to work withmathematical concepts such as probability and statisticalinference, and fundamentals of plane and solid geometry andtrigonometry. Ability to apply concepts such as fractions,percentages, ratios, and proportions to practical situations.

Reasoning Ability:

Ability to define problems, collect data,establish facts, and draw valid conclusions. Ability to interpretan extensive variety of technical instructions in mathematical ordiagram form and deal with several abstract and concrete variables.

Computer Skills:

Proficient in MS Office; familiar with SAP,project scheduling Knowledge of computer-aided design, database,project management, spreadsheet and word processing software,electronic mail, graphics, technical diagrams, flow charts, etc.
