We are seeking a licensed attorney to serve as a Compliance Director for a legal services company specializing in legal marketing and qualification services to top litigating firms across the country. The role will work closely with senior managers in marketing, operations, sales, HR, and technology to ensure adherence to regulatory compliance and ethical standards across our business.
Key Responsibilities:
Strategic Compliance Program Development:
Design and implement a scalable compliance framework aligned with the company’s strategic goals for national expansion.
TCPA Phone Compliance:
Oversee adherence to Telephone Consumer Protection Act (TCPA) regulations for all marketing and communication activities.
ABA Law Firm Ethics Compliance:
Ensure all operations align with the American Bar Association (ABA) ethical guidelines for law firm marketing and client engagement.
Cybersecurity, PII, and HIPAA Compliance:
Collaborate with senior technology and operations leaders to guide best practices around safeguarding Personally Identifiable Information (PII), HIPAA compliance, and data privacy in client acquisition processes. Help assess current practices and shape foundational policies to improve security posture and compliance across marketing and intake workflows.
Fraud Mitigation and Complaints Oversight:
Monitor fraud prevention programs, investigate complaints, and recommend corrective actions to maintain operational integrity.
Vendor and Third-Party Compliance Management:
Oversee compliance of third-party vendors (e.g., call centers, marketing agencies) with TCPA, HIPAA, and other relevant regulations, ensuring contractual agreements align with legal and ethical standards.
Training and Education Programs:
Develop and deliver training for staff and law firm partners on compliance requirements, including
TCPA, ABA
ethics, cybersecurity best practices, and fraud prevention, to foster a culture of compliance.
Audit and Reporting:
Conduct regular internal audits of marketing campaigns, data handling processes, and client qualification procedures to identify and address compliance gaps. Prepare reports for leadership and regulatory bodies as needed.
Client Data Privacy Policy Development :
Create and update policies to ensure transparent handling of client data, including consent management for marketing communications and compliance with state and federal privacy laws (e.g., Georgia data protection laws).
Regulatory Monitoring and Updates:
Stay abreast of changes in relevant laws (e.g., TCPA, HIPAA, ABA rules) and emerging legal marketing regulations, advising leadership on necessary adjustments to policies and procedures. Liaison with
