The Corporate Compliance Officer (“CCO”) oversees the compliance program and maintains an effective compliance program in accordance with federal and state laws and regulations and Evergreen Health’s annual compliance work plans, policies, systems, and processes. The CCO is responsible for developing, implementing, maintaining, monitoring, and enforcing the compliance program for Evergreen Health and its affiliates. This position reports to the Chief Legal Officer, with dotted line reporting to the Board of Trustees. As part of the essential functions of this role, the Corporate Compliance Officer is responsible for these areas : Develops/Manages Compliance Program + Manages day-to-day operations of the Compliance department. + Updates and monitors the implementation of all aspects of the corporate compliance program, and continually looks for ways to improve compliance systems and processes + Maintains a system to effectively monitor and stay current on changes in federal and state laws and regulations, advises leadership of changes, and proactively works with leaders and managers to implement effective compliance strategies and policies + Creates and manages annual compliance work plan, audit work plan, and compliance training plans Compliance Reporting + Reports at least quarterly to the Evergreen Health Corporate Compliance Committee and at least annually to the Board on all Corporate Compliance Program matters + Regularly and effectively communicates with leadership, management and all staff members on all compliance matters and responds to all communications in a timely fashion + Ensures proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate or required and liaises with regulators and outside agencies with investigational authority Conduct Investigations / Resolve Compliance Issues + Responds to alleged violations of rules, regulations, policies, procedures and standards of conduct by evaluating or recommending the initiation of investigative procedures and/or corrective measures for matters falling under the purview of this position + Collaborates with other departments to direct compliance issues to appropriate channels for resolution and/or investigation + Ensures that compliance issues and concerns within the organizations are being appropriately evaluated, investigated, and resolved Policy Development + Develops, maintains, and revises policies and procedures for the general operation of the compliance program and its related activities to prevent fraud, waste and abuse and illegal, unethical, or improper conduct + Reviews organizational policies to ensure compliance with

HIPAA, 42 CFR

Part 2, PHL Art. 27-F, MHL §33 and other applicable federal and state regulatory requirements around patient confidentiality Compliance Education/Training + Works with the Human Resources Department and others to develop and routinely update an effective compliance training program for new and existing staff + Oversees Compliance education program Monitoring and Auditing + Oversees conflicts of interest matters and disclosures in accordance with Evergreen Health policies and applicable laws and regulations + Oversees systems to safeguard Protected Health Information and all other patient information protected by state and federal law, and serves as HIPAA Privacy Official Risk Management + Handles certain risk management functions around patient complaints of regulatory violations, ensures appropriate insurance coverage and claims handling, and manages relationships with insurers and brokers Additional responsibilities include supervising compliance team members, participating in committee meetings, and consulting with the Chief Legal Officer as needed to coordinate handling of compliance and legal matters. Qualified Candidate will have a background in health care law as a practicing attorney or health care compliance as a compliance professional in a senior role, with knowledge of HIPAA and fraud and abuse laws; J.D. or Master’s in a related field required (MPH or MHA preferred); Minimum of three (3) years of experience required, five (5) years of experience preferred; candidate must be well versed in state, federal and local healthcare compliance laws and regulations; corporate compliance/HIPAA related certifications preferred; candidate will be highly self-directed, proactive, organized and detail oriented, exercising excellent business judgement and a positive teamwork-oriented attitude; must have familiarity with MS Office Software (Outlook, Word, Excel); candidate will have excellent time management, problem solving, and organizational skills; sensitivity toward cultural diversity, people living with HIV/AIDS and lifestyle and addiction issues is essential.

J.D. or Master’s in a related field required (MPH or MHA preferred)

Experience:

minimum of three (3) years in a senior corporate compliance role required, five (5) years preferred; experience with state, federal, and local healthcare compliance laws required
