Job Description
JOB OVERVIEW
The Senior Real Estate Paralegal will assist the Development Law Department’s Property Law Administration (PLA) Team in ongoing property management matters for the Company’s growing real estate portfolio, which includes over 2,100 operating restaurants that are owned or leased by the Company. The Senior Real Estate Paralegal will maintain databases and legal files related to all of the Company’s real property assets, review and interpret various real estate-related legal documents to provide information about the Company’s rights and obligations, and assist with the resolution of conflicts about those rights and obligations. Principal internal clients include the Company’s accounting, tax, litigation, risk management, asset management, facilities, licensing and operations departments; and the Senior Real Estate Paralegal will also frequently communicate with governmental entities, landlords, developers, and neighboring property owners.
ROLES AND RESPONSIBILITIES
- Abstracts leases and other legal documents and enters data into database program, collaborating with other departments on data management issues, systems and procedures to insure that the database is accurate and suitable for the generation of reports.
- Implements and sustains processes and controls for auditing purposes.
- Provides assistance with interpretation of legal documents to resolve disputes and matters related to the payment of fixed rent, common area maintenance (CAM) charges, taxes and percentage rent.
- Reviews communications related to real property, including default letters, notices of violation, requests for information, and requests for changes to legal documents (easements, declarations, etc.).
- Reviews real estate legal files to identify, manage, and communicate business risks and opportunities.
- Works with various departments to solve problems, resolve disputes and anticipate issues that may arise in relation to the
- Company’s real property assets.
- Prepares responses, including default letters, letter agreements and other communications, to real estate-related issues and tracks progress to insure those issues are resolved.
- Prepares amendments to leases, declarations, easements and other modifications to real estate-related documents.
- Prepares estoppel certificates and SNDAs for properties in the Company’s real estate portfolio.
- Assists with the review of litigation-related documents (pleadings, affidavits, etc.) and with the settlement of real estate, tax or property accounting-related litigation matters.
- Negotiate and draft documents (contracts, lease assignments, etc.
) and conduct closings in conjunction with the disposition of the Company’s real property assets.
PREFERRED EDUCATION AND EXPERIENCE
- A 4-year Legal Assistant’s degree or a 4-year Bachelor’s degree or Paralegal Certification (equivalent education, training and/or experience may be considered).
- Completion of a certified legal assistant program or equivalent property management training.
- Experience in a large law firm, commercial property management firm or in-house legal department.
KEY QUALIFICATIONS
- 6+ years of experience handling sophisticated commercial real estate legal matters.
- Strong background and proven experience in drafting, reviewing and interpreting commercial real estate documents related to property management issues.
- Demonstrated analytical, organizational, drafting and problem-solving skills.
- Excellent written and verbal communication skills, including the ability to clearly and concisely articulate complex legal concepts for a lay audience.
- Ability to work independently, collaborate/coordinate with multiple groups and handle multiple tasks concurrently.
- Proficiency in various computer applications, including Microsoft Office (i.e. Word, Excel, Outlook and Teams).
