The Role:
The Intellectual Property Attorney will serve as the primary intellectual property advisor for Xylem’s research and product development teams in Xylem’s Measurement and Control Systems segment and will develop and execute intellectual property protection strategies aligned with key business objectives. You will collaborate with the global Intellectual Property team to support Xylem’s businesses around the world.
The Intellectual Property Attorney role encompasses a broad range of challenging and essential intellectual property (IP) rights activities supporting the IP portfolios and the IP positions of Xylem’s businesses. These activities include working on intellectual property matters to ensure that Xylem IP is appropriately developed, enhanced, maintained, protected, and exploited.
Key Responsibilities:
Manage the patent portfolio and perform related activities across various product and technology areas, including invention identification, invention disclosure meetings, and strategic portfolio assessment
Oversee day-to-day worldwide patent prosecution and post-allowance efforts including continuations and international counterpart applications
Collaborate with outside counsel to manage the preparation and prosecution of domestic and international patent assets
Support of the R D organization, including client counseling, freedom-to-operate analysis, due diligence analysis and reporting, and helping to identify non-patent legal or business risks
Engage and collaborate with global legal, business, and engineering teams to identify and protect products, projects, and services
Protect Xylem’s brands and manage Xylem’s trademark portfolio, including conducting trademark searches and preparing opinions on trademark availability
Collaborate with outside counsel to file trademarks locally and overseas
Advise business partners on licensing agreements, development agreements, IP aspects of commercial transactions, in addition to advising on the IP aspects of mergers and acquisitions.
Prepare and provide trainings and other presentations for internal stakeholders on IP issues
Drive special projects, including establishing strategies, guidelines, processes, and procedures, to enable the IP legal team to provide best in class service to its partners
Support U.S. and non-U.S. litigation, oppositions, IPRs, or other judicial and non-judicial proceedings around the world.
Qualifications:
Professional Characteristics U.S. Law Degree (juris doctorate) from an accredited law school.
5+ years of experience in preparing and prosecuting domestic and international patent applications and providing patentability, validity, and infringement assessments
Admitted to practice law in at least one U.S. state.
Admitted to practice in front of the U.S. Patent and Trademark Office (USPTO bar admission).
Patent litigation experience a plus, but not required.
Technology transaction experience a plus, but not required.
Trademark prosecution and clearance experience a plus, but not required.
Undergraduate degree in engineering or computer science preferred.
