THE STARTING SALARY FOR THIS POSITION IS LIMITED TO

Responsibilities:

The attorney in this position is assigned to defend and when necessary perfect appeals in civil suits against the DMV and its employees. The attorney is assigned to both novel and complex litigation involving motor vehicle law and well as more routine litigation involving driver license revocations; inspections license revocations; vehicle ownership disputes; vehicle registration denials; vehicle classification disputes; dealer and salesman licensing; manufacturer licensing and regulation; financial responsibility; bankruptcy; taxation; and other relevant cases as may be assigned. Some of these matters become highly complex and nuanced and require a high degree of knowledge, experience and specialization for their successful completion. Suits may involve constitutional claims for significant amounts of money, injunctive or other equitable relief from the practices of DMV; and may involve issues of precent which can have lasting impacts on the policies and practices of the Division. The attorney in this position provides legal advice to the Commissioner, Deputy Commissioners, and Directors of DMV on a myriad of diverse topics related to their statutory duties and responsibilities. The attorney in this position is required to have extensive knowledge and a complete understanding and familiarity with the state and federal statutes governing and impacting DMV operations, the associated administrative codes, and the relevant case law interpreting them. This attorney must be able to interpret constitutional provisions, state and federal statues and administrative codes, state and federal regulations, and state and federal court decisions and precedent, and also apply them to DMV’s operations to determine whether changes should be made to its policies and practices in order to comply with the existing law. The Motor Vehicles Section of the Attorney General’s Office provides comprehensive legal services to the Commissioner of the Division of Motor Vehicles, staff and directors and other Division employees. The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions. Knowledge, Skills and Abilities / Competencies Ability to determine issues in various cases.

Ability to establish and maintain effective working relationships.
Ability to creatively develop case strategy and tactics. Minimum Education and Experience Requirements Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.

GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

 Experience in applying Chapter 20. Experience representing the Division of Motor Vehicles. Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
