Title 23-1010 LAWYERS-3. This position has a 37.5-hour work week and is considered exempt.
SUMMARY :
As a member of the Office of the Commissioner’s Legal Unit and under direct supervision of the Administrator, provides legal advice and consultation to the Department of Safety with regards to civil legal matters and liabilities.

MINIMUM QUALIFICATIONS
Education :
Juris Doctorate from an American Bar Association recognized law school.
Experience :
Five years’ experience in the active practice of law.
License/Certification :
Valid driver’s license and/or access to transportation for statewide travel.
PREFERRED QUALIFICATIONS
Experience in providing counsel to public sector agencies is preferred.
SPECIAL REQUIREMENTS
1. Must be an active member of the New Hampshire Bar Association and in good standing. 2. Selected candidate will undergo a fingerprint-based criminal background check and motor vehicle check to ensure suitability for exposure to confidential information.
RESPONSIBILITIES
Drafts administrative rules and participates in the administrative rulemaking process to insure compliance with state and federal laws, as well as fulfillment of the agency objectives. Responds to complaints, requests for information, and correspondences of a legal nature relating to the Department of Safety. Provides legal counsel and assistance in responding to Right to Know requests to insure the proper release of records in a timely manner and in compliance with law. Reviews and approves contracts, memorandums of agreement, and memorandums of understanding between the Department and other agencies, organizations or third parties. Provides oversight to subordinate staff assigned to the Legal Unit, including training and guidance, and reviewing work for accuracy. Trains and provides education to Department staff regarding issues of responsibility and authority. Appears before state administrative agencies, to include drafting pleadings, motions, discovery, preparing witnesses, and presenting evidence. Provides technical and drafting assistance for legislative initiatives to amend existing statutes or enact new legislation to further the Department’s policies and objectives, and serves as the Department’s representative with regards to any testimony before Legislative Committees. Provides legal advice and support to the management of the Department of Safety, including conducting legal research and preparing opinions.
