Performs professional and administrative work as required to provide an adequate defense. Reports to the City Attorney. Essential Functions The essential functions listed below are those that represent the majority of the time spent working in this class. Management may assign additional functions related to the type of work of the class as necessary.
- Prepares cases for defense, performing such duties as diagnosing cases and negotiating with the Prosecutor, applying the law to facts of a criminal case to properly advise and defend qualifying indigent individuals charged with municipal charges in bench trials, jury trials, and or guilty pleas or dismissals.
- Keep abreast of all new criminal legislation and case law that affects municipal courts and cases.
- Receives and responds to difficult and sensitive client concerns and complaints.
- Conducts trial work, oral and written arguments, case analysis, legal research, witness interviews, correspondence, communication with Prosecutor, negotiations, etc.
- Operates a variety of office equipment, including a computer, printer, scanner, fax machine, calculator, copier, telephone, etc., and utilize up-to-date technology.
- Interacts and communicates with various groups and individuals, city personnel, law enforcement personnel, government officials, professional peers, and the general public in a respectful, effective, and professional manner.
- Knows how to react calmly and quickly in emergency situations. Can successfully work under stressful conditions.
- May be designated to report to work during hazardous weather or emergency conditions.
- Performs related work as may be required. Knowledge, Skills and Abilities
- Has thorough knowledge of the methods, procedures, and policies of the City as they pertain to the performance of duties of the public defender.
- Is knowledgeable in the laws, ordinances, standards, and regulations pertaining to the specific duties and responsibilities of the position.
- Has knowledge of current principles and practices of criminal law; courtroom / judicial procedures and processes; methods and techniques of legal research; established precedents, case law and sources of legal reference applicable to the role of a defense attorney.
- Knowledge of proper English usage, punctuation, spelling and grammar and paying attention to detail in preparing reports and correspondence. Ability to communicate effectively both verbally and in writing.
- Ability to complete assignments and be personally accountable for all equipment, computers, City vehicles and City property.
- Ability to be reliable in terms of attendance and punctuality.
- Ability to take initiative without the need of direct supervision; make sound judgement decisions in routine and non-routine work assignments and analyze problems or procedures and evaluating alternatives by selecting the best course of action.
- Ability to provide excellent customer service to all internal and external customers in the delivery of City services by following through on customer requests in a positive, courteous, timely, respectful and professional manner with the utmost integrity in the best interest of the public.
- Behave consistently regarding the City’s expectations for ethical conduct and present self in a professional and positive manner and accept responsibility for actions. Makes decisions in the best interest of the City.
- Manages time and priorities effectively to achieve objectives.

- Ability to handle stressful situations and react calmly and quickly in emergency situations. Minimum Education and Experience Requirements
- Requires a Juris Doctorate degree from an accredited law school supplemented by one or more years of responsible experience in the field of law, or an equivalent combination of education, training and experience that provides the required knowledge, skills, and abilities.
Must possess and maintain membership in the South Carolina Bar Association. Must possess a valid state driver’s license. Physical Demands
- Tasks involve the ability to exert very moderate physical effort in light work, typically involving a combination of stooping, kneeling, and crouching, and the lifting, carrying, pushing and/or pulling of objects and materials of moderate weight (up to 20 pounds).
- Ability to perform sedentary work and sit for extended periods of time. Ability to stand, walk and climb, as necessary, for extended periods of time.
- Clarity of speech and hearing or other communication capabilities to enable the employee to follow instructions and communicate effectively.
- Requires visual acuity and visual perception to prepare and analyze data and figures; examine and work with maps, charts, and detailed materials; inspect sites regarding planning issues; operate a computer; and do extensive reading.
- Manual dexterity to enable the employee to operate a personal computer and related equipment using repetitive motion and/or substantial movements of the wrists, hands, and fingers. Unavoidable Hazards (Work Environment) Unavoidable hazards refer to the job conditions that may lead to injury or health hazards even though precautions have been taken.
