The County Attorney’s Office provides professional legal representation to County Council, the County as an entity, elected and appointed County officials and the County Departments in litigation either brought against the County or initiated by the County. This position typically provides prioritization of work duties for maximum efficiency; develops and utilizes best practices; seeks process improvement through numerous resources. Duties

ESSENTIAL JOB FUNCTIONS

Provides legal advice to County Council, the County Administrator and County staff. Research legal issues. Prepares and reviews legal documents and instruments. Attend County Council meetings and retreats. Drafts memoranda, ordinances, and resolutions, negotiates, drafts and reviews contracts, and handles some litigation including at the Administrative Court level. Advises staff and County officials on the application of various County ordinances, state and federal laws and policy matters and issues; handles contact administration and disputes. Maintains effective working and administrative relationships with various departments, boards, and courts and offices. Responsible for all aspects of case preparation including motions, responses to motions, witness interviews, depositions, appeals and all related tasks. Research and interpret the law as it applies to county government in multiple practice areas as assigned. Areas may include but are not limited to land use, special districts, water law, contracts and procurement, property valuation and assessment, taxes (property, sales and use), financing and budgeting, roads, bridges, and transportation, Taxpayer’s Bill of Rights (TABOR), elections, employment law, civil litigation, constitutional claims, zoning and building code enforcement, mental health and alcohol commitments, open meetings, public records, and the day-to-day business of the county. Drafts and reviews resolutions. Drafts and reviews contracts, intergovernmental agreements, memoranda of understanding, and the like. Participates in negotiations, mediation, arbitration, settlement conferences, client meetings, and/or meetings with members of the public. Supervises staff and provides work assignments. Maintains satisfactory working relationship with county departments, offices, and agencies, elected officials, court and court staff, opposing counsel, all fellow employees, and all others with whom contact is had in this professional capacity. Performs other related job duties as assigned.

Qualifications Education and Experience:

Juris Doctor degree from an ABA accredited law school. Must be admitted to practice law in South Carolina (member of South Carolina Bar in good standing). Must have completed all Rule 403 requirements. At least four (4) years’ experience in local government is preferred, but not essential. Eight (8) years of litigation or other trial-based experience required. Must have and maintain a valid driver’s license for South Carolina. Additional Requirements None.

Work is performed in a relatively safe, secure and stable work environment. Dorchester County has the right to revise this job description at any time. Position Type and Expected Hours of Work This is a full-time position; typical work hours and days are Monday through Friday, 8:30 a.m. to 5:00 p.m. Some flexibility in hours is allowed, but employees must be available during the “core” work hours of 9:00 a.m. – 4:00 p.m. and must work 40 hours each week to maintain full-time status. Employees must be available to work evenings, weekends and holidays during emergencies or as requested. E.O.E.
